Background check laws have been trending for years. The most common challenges for employers: (1) they differ depending on state, and even locality; and (2) states and municipalities continue to pass new laws and change existing laws – seemingly on a monthly basis. This webinar will start by providing an overview of the background check laws applicable in our region. Then, it will examine two of the most noteworthy changes to background check laws in 2021 – from Illinois and New York – to provide insights on some of the more restrictive recent trends that could be coming to our area.

Accommodations, accommodations and more accommodations...  Many of you have seen more requests in the last year than in your entire lifetime, and they are no longer primarily disability related.  Religious and disability accommodation requests are sweeping the nation with some employers seeing thousands of requests.

Many employers feel comfortable processing ADA accommodation requests but are finding the law governing both religious and disability accommodation requests mysterious and challenging.  Please join us for this timely webinar.  Jackson Lewis Partner, Stephen Paterniti will explores this workplace dilemma and address the challenges presented, and offer practical solutions for managing these and other leave-related requests.

More than eighteen months since the Covid-19 pandemic began, the traditional work model has changed for most California employers. With remote work and hybrid working schedules, companies and their employees are adapting to a changing workplace.  The laws enacted to govern the traditional physical workplace must now be applied to the virtual one.  This shift has led to new legal challenges for companies and their in house lawyers.  This webinar will discuss the top employment law challenges the “new normal” raises for companies, and the best practices for addressing them.  We will also look at new laws and other changes impacting employers in 2022

Overview:
This program will examine how a myriad of COVID safety rules and regulations require employers and their governing boards to balance risk tolerance, complex legal issues, and the practical implications of their decisions.  As companies rollout or avoid vaccination policies, a number of critical business areas essential to a company's success conflate, including employee health and safety, employee morale and retention, an inclusive corporate culture, and litigation and reputational risk management.

In the context of these critical business areas, this ACC program will address:

·      Recent legislation providing COVID liability protection;
·      Mandatory versus voluntary vaccination policies;
·      Wage-and-hour implications (and incentives) relating to vaccination policies;
·      COVID vaccination regulations and executive orders for large employers and federal contractors;
·      Status of legal challenges to OSHA's Emergency Temporary Standard and executive orders;
·
Dealing with disability and religious-accommodation requests;
·      The Board's role in crafting vaccination policies and overseeing remote-working arrangements that may continue after the pandemic.
