The regulatory landscape has changed dramatically in recent times, with regulators such as ASIC spearheading civil and criminal proceedings against individuals in order to compel cultural change within corporate Australia. ASIC’s commitment to the “why not litigate” approach since the Financial Services Royal Commission is accompanied by increased civil and criminal penalties for companies and their directors and officers and a substantial uplift in funding.  In recent months, the ACCC has been successful in securing large Court ordered penalties against individual directors for their role in breaches of the Australian Consumer Law.

In light of this unprecedented regulator activism and focus on the liability of individuals, ensuring effective awareness, co-operation and compliance with the laws governing your business has never been more important.

This webinar, presented by Gilbert + Tobin’s award-winning Disputes + Investigations team, will cover:

  • recent trends and developments regarding individual liability in the Australian regulatory landscape and abroad;
  • recent decisions involving civil and criminal liability for individuals including directors and officers;
  • the review by the Australian Law Reform Commission into the corporate criminal responsibility regime and other proposed law reform; and
  • practical considerations for an in-house legal team.

Are you noticing that working from home has left you feeling sluggish and lacking the get-up-and-go you used to have to prioritise in healthy activity? If so, you’re not alone and the In-house In Health committee have organised a special surprise for you.

We have engaged healthy living activist, health coach, ironman Triathlete and marathon runner, Andre Obradovic, to run a pilot health and wellness program to help kickstart your 2021. The program will involve regular webinars focused on a range of ways to improve your levels of health, fitness and vitality over a four-month period. You will also be provided access to Andre's Health and Wellness app which provides a wide range of health and wellness content.

This webinar is designed to allow Andre to share his story with you, from corporate burnout and dropout, to a wellness advocate fitter than he was in his twenties and living a life of purpose and productivity.

Come to simply hear an inspiring story or decide whether you’d like to be part of the Kickstart 2021 Health and Wellness Program. Either way, it’ll be a positive and thought-provoking way to start your week.

Justin Coss, ACC Australia’s President, will join Sylvain Mansotte, CEO & Co-founder of Whispli, for a discussion on how good technology combined with the right mindset can assist organisations in mitigating the risks related to misconduct and wrongdoing.

Sylvain was the whistleblower on a $20m+ fraud before turning investigator for that very same organisation. This experience prompted him to start Whispli, the industry leader in whistleblowing platforms for ethical and security-conscious organisations.

Since then, Whispli has helped hundreds of companies of all sizes (including the ACCC, Westpac and Qantas) implement their whistleblowing program.

What you’ll learn from this session:

  • Sylvain’s unique story and experience as a whistleblower
  • What makes a successful whistleblowing program
  • New ideas/thoughts on how to increase visibility on matters related to misconduct
  • How to engage your employees to speak up
  • Issues to consider in adapting your whistleblowing program to the new normal

COVID-19 and its associated restrictions have disrupted more than work and commerce.

Key employer and employee representative bodies have been invited to set aside historically adversarial approaches to employment relations, in favour of a new determination by the Morrison government to promote tripartite discussions over changes to the Fair Work Act.

In this presentation, Professor Andrew Stewart and partners from Piper Alderman's Employment Relations team will assess the prospects for meaningful reform in relation to awards, enterprise bargaining, casual employment and compliance mechanisms – and explain what this could mean for your business.

Even if you cannot join the live webinar, register for the live session and the on demand recording will be shared with you to view at your convenience.

In this session, Baker McKenzie Partner, Toby Patten, and Special Counsel, Caitlin Whale, will cover the law and provide practical tips for drafting and negotiating limitations of liability.

The world is changing rapidly and businesses are required to move quickly and pivot to remain relevant and keep afloat during these weird times. Australia has passed the 100 day mark of dealing with COVID19 and the world has settled into the virtual world. Legal counsel are critical to decision-making and play a critical role in ensuring risk and compliance are mitigated and controlled. For those who are new to in-house, what can you do to make your mark and demonstrate your worth to the business during these times? What skills are required to ensure that you are being as relevant and critical to the business strategy and operations?

This virtual panel discussion will work through these questions and more. Our guests will share their insights and open it up to the floor to hear what is happening in your organisation and the impact and value you are able to provide to your team and organisation during these times.

Following the presentation ACC Australia will be hosting a virtual networking session from 12.00 PM using our new virtual event platform! Grab a drink and we’ll break you into smaller groups so that you can catch up with peers, discuss the insights gained, share what you’ve been experiencing in your own workplace.

Please note registrations for this event are now closed.

Senior in-house lawyers are increasingly required to bring more to the table than just their legal expertise. As well as legal and business advisors, senior in-house lawyers are expected to be agile leaders of growth, change and innovation.

The pandemic has given agile leadership the ultimate test, and the best leaders are using their self-disruptive skills to help their organisations adapt. In this webinar, Korn Ferry will discuss how lawyers can help lead their teams and businesses to not only survive, but thrive, in crisis and beyond. This session will focus on:

  • What we have learned about leadership in crisis
  • Defining The Self-Disruptive Leader
  • How to cultivate leadership capabilities
  • Guidance to help you lead your teams and organisation through the turn.

Whilst people movement is on pause, movement of goods and services continues, perhaps more essential than ever. We will be talking about some of the hot legal issues, including brand reputation and IP protection, and managing insolvency, product liability, dispute and corruption risks.

“I am always looking at striving towards best practice but find in a busy work environment the time to assess and reflect is limited. The ACC  in-house certification program allowed me to take some time out and listen, learn and develop from a wide range of in house experts. The course is fast paced, engaging and provides you with a vast tool kit of best practice to take back to your role and organisation.”

Jason Arnheim, General Counsel Australasia, Orora Limited. ACC In-house Certification Program Alumni, Sydney 2019

"The ACC In-House Counsel Certification course was the single best learning and networking event I attended in 2019. In four days, the program helped me unpack my skills and experiences as a senior in-house counsel managing a team; and realign them with international best practices to support me in effectively advising my organisation and leading the in-house function. This course is a must for in-house lawyers ready to effectively lead their organisation into the future."
