Non-financial risks can inflict a devastating financial impact on a company.  ASIC and other key regulators are seeking to hold corporates to account for failing to exercise active stewardship of non-financial risk. Australian directors and senior executives are increasingly alive to these risks in the wake of COVID-19.

Join Gilbert + Tobin’s market-leading experts David Clee and Elizabeth Hill for a live webinar on board oversight and monitoring of non-financial risks.

  • the impact of failing to oversee and monitor non-financial risk;

As COVID-19 continues to pose  significant challenges to most sectors of the economy, Baker McKenzie Partners Adrian Lawrence and Aleisa Crepin take a look at key contractual provisions and  doctrines relevant to disrupted commercial dealings, including:

  • provisions dealing with delay in performance and the allocation of economic  burdens in the case of such delay;
  • termination of commercial contracts due to force majeure or frustration;
  • other contractual provisions such as stop payments, step-in rights and MAC clauses; and
  • considerations for renegotiation of contracts in the light of continuing  COVID-19 disruptions.

The toll the COVID-19 pandemic has taken on the financial, physical, and mental health of so many has been something none of us could have imagined six-months ago. While some in-house lawyers have found themselves without a job or on reduced hours, the vast majority are still working, only now from their homes, and under even higher levels of stress then previously experienced. While paid workload has increased in response to the changing regulatory and employment landscape, so too has childcare and domestic labour. Meanwhile, de-stressing methods, such as attending a gym or socialising outside of small groups, are no longer an option.

In this webinar, Paul Garth (Account Director, Vario from Pinsent Masons) will engage with Workplace Mental Health Advocate and Award-Winning Senior In-house Lawyer at Spark (NZ), Grant Pritchard, to unpack the challenges felt by in-house legal teams at this time. Jemima Harris and Dave Curtain, LOD’s Innovation & Design Directors, will explain the role of design thinking and user experience in improving in-house legal processes. Jemima Harris and Dave Curtain, LOD’s Innovation & Design Directors, will take you through the end to end process of planning and implementing a project to improve legal process. This session will cover the earliest stages of assessing opportunities for change, choosing the right sort of project, change management, project management, reporting through to post-implementation reviews.    

Dealing with suspicions or allegations of fraud, corruption or staff misconduct at your workplace is a daunting task. If not dealt with quickly and appropriately, it could have serious financial and reputational risks for your organisation, yet faced with current COVID-19 restrictions with many of us working remotely, how can you still efficiently manage a workplace investigation away from the office?

Following on from FTI Consulting’s misconduct investigation workshops in 2019, this webinar will looks at the practicalities of running an investigation remotely. From identifying and collecting evidence (including data collections), to remote hosting and analysis of evidence, to conducting witness and person-of-interest interviews. FTI Consulting will take you through the various stages of running a remote investigation.

The workshop will cover the following:

  • Introduction to investigation theory
  • Initial response to an allegation
  • Undertaking the investigation – all from afar

  • Appraise remote investigation techniques, and consider their practical application within a given investigation
