The regulatory landscape has changed dramatically in recent times, with regulators such as ASIC spearheading civil and criminal proceedings against individuals in order to compel cultural change within corporate Australia. ASIC’s commitment to the “why not litigate” approach since the Financial Services Royal Commission is accompanied by increased civil and criminal penalties for companies and their directors and officers and a substantial uplift in funding.  In recent months, the ACCC has been successful in securing large Court ordered penalties against individual directors for their role in breaches of the Australian Consumer Law.

In light of this unprecedented regulator activism and focus on the liability of individuals, ensuring effective awareness, co-operation and compliance with the laws governing your business has never been more important.

This webinar, presented by Gilbert + Tobin’s award-winning Disputes + Investigations team, will cover:

  • recent trends and developments regarding individual liability in the Australian regulatory landscape and abroad;
  • recent decisions involving civil and criminal liability for individuals including directors and officers;
  • the review by the Australian Law Reform Commission into the corporate criminal responsibility regime and other proposed law reform; and
  • practical considerations for an in-house legal team.

Christiana McCudden, Partner - Gilbert + Tobin

Christiana is a partner in Gilbert + Tobin’s Disputes + Investigations group, based in Melbourne.



Christiana has practiced in commercial litigation for more than twenty years, advising public and private clients and individual officers or directors on a variety of commercial and corporate disputes.



Christiana has extensive experience acting in large disputes involving issues such as breaches of ACL, Corporations Act or directors’ duties and also advising clients regarding statutory investigations, royal commissions and their dealings with regulators. She has strong experience advising clients in regulated environments and the contexts in which directors and officers are required to make decisions about their business’ commercial operations and relationships. Christiana is a litigator with strong strategic and commercial approaches, working with her clients to identify, manage and respond to risks in the most effective way possible.

Mitchell Coidan, Senior Lawyer - Gilbert + Tobin

Mitchell is a senior lawyer in Gilbert + Tobin’s Disputes + Investigations group, based in Melbourne.



Mitchell has experience in the areas of commercial litigation, joint venture mining disputes, class actions involving the banking and finance industries, energy and resources disputes (including renewable energy), insurance litigation, negligence and toxic tort litigation and misleading or deceptive conduct.



Since joining Gilbert + Tobin in 2018, Mitchell has taken a leading role on behalf of an ASX listed company in the defence and prosecution of proceedings in the Supreme Court of Victoria, and often appears in the Supreme Court in that role. He has also taken a lead role in instructing Counsel and managing the evidence in highly contentious and publicised proceedings involving a regulated environment at a trial in the Supreme Court of Victoria. 



As well as being admitted in Victoria, Mitchell also spent 10 years in civil and commercial litigation in New South Wales.

Gabrielle Lyons, Senior Lawyer - Gilbert + Tobin

Gabrielle is a senior lawyer in Gilbert + Tobin’s Disputes + Investigations group, based in Melbourne.



She recently acted for Harold Mitchell AC in an ASIC civil penalty proceeding in the Federal Court of Australia (judgment is reserved). Gabrielle has particular experience acting for clients in the media and broadcasting sector and brings in-depth insights from her time spent in-house with large national and global media organisations. Gabrielle has a diverse portfolio of litigation experience including acting in general commercial litigation, defamation, contract disputes, consumer law, construction, bankruptcy, intellectual property and coronial inquests.



As well as being admitted in Victoria, Australia, Gabrielle has spent time amassing litigation experience in New York.
