On May 25, 2018, the EU's General Data Protection Regulation (GDPR) went into effect and on June 28, 2018, to avoid a voter ballot initiative, California passes a hastily drafted bill aimed directly at companies who sell the personal information of California consumers. The passage of the California Consumer Privacy Act (CCPA) sets off a chain reaction and other states (e.g. Nevada and New Hampshire) adopt similar legislation. And just like that, in a matter of months, US companies have to face consumer privacy from an entirely new direction. The race for federal preemption has emerged but a federal law on consumer privacy, which would un-seed state momentum has not yet seen the light of day, so California remains the lead state that is shaping the US data privacy landscape. Is your company compliant with the CCPA and other local privacy laws and have you planned for what data privacy looks like in 2020? 

 

We will explore the current state of data privacy in the US (including the CCPA Regulations and the CPRA on the ballot in November); what companies should be looking for in applicability and scope of local data privacy legislation as well as how to measure and contain the operational impact of these new laws.  We will also look at best practices for compliance in light of Covid-19, working from home and data privacy as part of safety and security.

Dominic Rota’s practice encompasses diverse areas of interest, including patent prosecution and litigation, trademark litigation, and intellectual property licensing. A Registered Patent Attorney through the United States Patent & Trademark Office (“USPTO”), Dominic received his B.S. in Physics, with Minors in Mathematics and Chemistry, from Belmont University in 2015. Dominic earned his J.D. from Belmont University College of Law in 2019, and subsequently began practicing law in Tennessee as a Patterson Intellectual Property Law associate later that year.

As Dominic continues his associateship with Patterson IP Law, he wishes to expand his scope of practice to include trademark prosecution, trade secret counseling and litigation, and counsel for matters related to information security and data privacy.

Ryan D. Levy is the managing shareholder at Patterson Intellectual Property Law and co-chairs the firm’s Litigation Practice Group. He is an accomplished litigation attorney focusing on complex patent disputes in a variety of technologies, including industrial and automotive machinery, chemical, medical devices, and software ranging from web-based protocols to automated detection systems.

Ryan has a wide range of litigation experience before federal district courts, the U.S. International Trade Commission, proceedings before the U.S. Patent and Trademark Office, and various arbitration forums. In addition to his litigation practice, Ryan also counsels clients on intellectual property procurement and licensing in both trademarks and patents.

Scott Douglass concentrates his practice in the areas of trademarks, copyrights, and data privacy by advising clients on licensing, transactions, and litigation in federal court. He is experienced in assisting clients on the adoption and protection of brands for their products and services in a wide range of industries including film, television, music, and entertainment, beer and spirits, food and restaurants, professional services, financial services, and pharmaceutical products. Scott prosecutes trademarks in the U.S. Patent and Trademark office and before the Trademark Trial and Appeal Board. He handles litigation relating to the enforcement of trademarks against third parties, as well as defending companies and individuals against charges of trademark and copyright infringement.

Ed Lanquist is an AV Preeminent-rated attorney who practices patent, trademark and copyright litigation, intellectual property counseling, trademark prosecution, and technology law. He has litigated more than 170 IP cases, and has filed more than 150 patent applications and 1,400 trademark registration applications. He also counsels clients on the economic benefits and implications of IP protection and litigation.

Jon Harris represents management in a wide variety of employment-related matters. In addition to defending single-plaintiff lawsuits, Mr. Harris also represents employers in class and collective actions. He has handled countless EEOC charges and defended employers in lawsuits brought by the EEOC, including matters where the agency has asserted systemic claims on behalf of multiple claimants.

In his decade-plus at Ogletree Deakins, Mr. Harris has obtained numerous successes, both in federal and state court. Over 70 cases can be found on Westlaw, where Mr. Harris was counsel for the defense; many of those decisions report dismissal on behalf of his clients. Mr. Harris is not afraid to represent employers in cases involving challenging facts, and he enjoys the opportunity to take a case to trial.

Mr. Harris is a frequent speaker on topics relating to all types of employment issues, and he works with clients on preventive strategies to avoid discrimination, retaliation and other employment claims. After graduating from the Washington University School of Law, from 2000 to 2001 Mr. Harris served as a law clerk for the Honorable E. Richard Weber, a United States District Court Judge in the Eastern District of Missouri.

Mr. Harris is a Fellow of the Nashville Bar Foundation. Mr. Harris has been recognized by the publications The Best Lawyers and Super Lawyers, and his peers have rated him as “AV Preeminent” in Martindale-Hubbell. Mr. Harris is the co-chair of the Labor and Employment Section of the Nashville Bar Association, a member of the Tennessee Bar Association’s Labor & Employment Law Section Executive Council, and a board member of Middle Tennessee Society for Human Resources Managers.

Kim Hodges is a shareholder in the Memphis office and has practiced employment law and litigation for over sixteen years. Prior to joining Ogletree Deakins, Kim was lead counsel in Federal Express Corporation’s litigation and employment group and worked in various roles in the HR departments of ServiceMaster – TruGreen ChemLawn, Trailmobile, and Riceland Foods.

Throughout her sixteen years as a litigator, Kim amassed a wealth of employment and commercial litigation experience and defended corporate clients as first-chair counsel in state and federal courts across the United States. She has represented clients in appeals before the 3rd, 4th, 6th, 8th, 9th and 11th Circuit Courts of Appeal and also has experience defending clients in matters before the EEOC, the Department of Labor, and appeals before the Administrative Review Board.

Kim’s litigation experience runs the gamut of employment law and related issues, including: all types of employment discrimination and harassment, wage and hour, FLSA classification, state and federal disability discrimination and accommodation, public access for disabled individuals, FMLA leave and interference, ADEA, complex contracts, non-competition and non-solicitation agreements, trade secrets, whistleblower claims, tort claims, and antitrust/unfair competition.
