Many employers’ social media policies -- if they exist at all -- have not been adapted for the post-pandemic, remote-work environment. And the lines between on-duty and off-duty are blurred now more than ever. Contemporary social media usage brings risks of harassment in nuanced forms, like trolling, doxing, and brigading. Dealing with Ongoing COVID Travel Bans: Strategizing for Maximum Mobility

Stalled or delayed visa processing at U.S. consulates has resulted in challenges for global organizations. Strict limits on travel into the U.S., rapid policy changes and reduced operations at U.S. consulates mean that employers and their immigration counsel must focus on their mobility planning. This session will outline the key challenges facing employers seeking to bring personnel into the United States, and offer strategies for seeking and obtaining exceptions to ongoing travel restrictions.

Employment Litigation Trends During COVID-19 And Beyond

 

This presentation will canvas the various litigation trends and developments related to COVID-19 both during the pandemic and beyond.  This highly relevant discussion will include how Courts across the country have handled COVID-related claims under the workers’ compensation laws, OSHA, the ADA, the FMLA, the wage and hour laws and under various common law and statutory retaliation theories.  We will also examine the latest position and guidance taken by the EEOC, the DOL and the CDC.  There will be a discussion on best practices and policies for employees who are beginning to return to work.

Wage-and-hour class actions, especially when coupled with representative claims brought pursuant to the California Private Attorneys General Act of 2004 (“PAGA”), can present California employers with astronomical theoretical exposure based on merely technical violations of the California Labor Code that cause no actual harm.  While well-crafted arbitration agreements can minimize the risk of most class action claims in the wage-and-hour context, PAGA claims cannot be arbitrated, and controlling caselaw offers employers fewer “exit ramps” short of a high-stakes trial.  This program offers an overview of wage-and-hour class actions and non-class PAGA actions, strategies for managing the risk of such cases, including when multiple follow-on cases are filed, and commentary on the key decision points affecting in-house counsel’s ability to apprise the business of these risks.

OVERVIEW

This program will discuss how changes in society are impacting the workplace. Particularly, this program will
explore how federal and state legislation following the #MeToo movement and racial protests has impacted
the ability for employers to maintain confidentiality when settling sexual harassment and discriminations
lawsuits. Also, will touch on how pay equity statutes are changing employers’ hiring and promotion processes.
Finally, will touch on what New York and New Jersey’s recent passage of adult use of cannabis impacts
employer’s drug testing policies during the hiring process and beyond.
