In this session, we will explore and discuss the types of claims we believe are on the horizon for 2022, what steps employers ought to be thinking about now to prepare themselves for those claims, and at 24 months in, what the future holds for pandemic related issues.  We will also provide predictions about how the pandemic may have changed the way the courts manage and handle litigation in the future.

COVID-19 has transformed the global workplace in myriad ways, including in terms of worker mobility.  Remote and hybrid working arrangements have proliferated during the pandemic, creating unprecedented opportunities for workers to “wander” to new locations and jurisdictions – both domestically and internationally.  But most employment law requirements are based on a worker’s geographic location.  Thus, this increased global mobility has created a wide variety of compliance issues that employers must appreciate and address.  When employees relocate, employers are confronted with a multitude of employment law compliance challenges, including:

·         State income tax withholding

·         Unemployment insurance

·         Workers’ compensation

·         Wage and hour law

·         Training

·         Leave and benefits

·         And more!

This presentation will discuss the challenges facing employers of wandering workers and provide practical insights to assist organizations manage legal compliance in connection with such employees.
