There is a myth that trials are “dead” and that cases either settle or get decided on dispositive motions prior to trial. However, many cases do go forward to a jury trial for a variety of reasons. Therefore, from the outset, employers and counsel should prepare all cases for the possibility of trial.

The presentation will focus on the state of arbitration in California, particularly the enforceability of mandatory arbitration agreements and the litigation surrounding which matters can be compelled to arbitration and which claims cannot be compelled.  We will discuss class action wavers, PAGA – Viking River Cruise, AB 51, the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, and CCP §§ 1281.97-1281.99 concerning arbitration fees and costs.

As a result of the WFH reality brought upon by the COVID-19 pandemic, many employers are reevaluating their approach to mandatory work locations. Indeed, many businesses are considering hybrid and fully-remote work policies, including the opportunity to work “from anywhere”, whether temporarily or permanently.  These policies may be helpful tools to retain existing human capital and recruit new talent. However, any policy permitting cross-border employment should be accompanied by an analysis of the related employment law implications. This presentation will walk ACC Members through the issue-spotting process and some of the key considerations that arise in this scenario.

In this tight labor market, many companies are wisely doubling-down on their diversity and inclusion focus.  In this presentation we will discuss the important role that internal communication can have on these efforts, with a specific focus on reducing micro-aggressions and implicit bias in the workplace.

Post Pandemic Agile Employment Models

Overview:

Business conditions including labor market shortages, real estate, and the pandemic have caused business to re-imagine their employment models.  Some companies have been essentially forced into multi-jurisdictional situations because they go where the talent is, even if it is remote or abroad.   Other companies incentivize return to office conditions with carrots and sticks.  This CLE will focus on lessons learned over the past 2.5 years and provide best practices for the future from an employment and immigration compliance perspective.
