This presentation will provide a practical discussion of workplace and employee relations considerations as businesses begin to reopen and more employees are asked to return from unemployment, furlough or working at home amid the COVID-19 pandemic. Please forward the link to this informative program to the HR professionals in your company! The discussion will include:

• Unemployment benefit issues, including potential conflict between the Families First Coronavirus Response Act enhanced unemployment benefits and CARES Act Paycheck Protection Program requirement that furloughed employees return to work;

• Leave issues/traps with new leave laws and the FMLA;

• Avoiding age related remarks/discrimination;

• Employee privacy (ADA and HIPAA);

• Worker’s compensation and other insurance coverage issues;

• Executive orders by governors, mayors, etc.;

• Local ordinances;

• Workplace health and safety guidance;

• Federal and state guidance for employers, typically industry specific, such as General Guidelines for Employers, Guidelines for Restaurants, Retail Guidelines, Exercise Facility Guidelines, and Lodging & Accommodation Guidelines;

Chuck is Vice-Chair of the firm's Litigation Practice and Co-Chair of he firm's Labor & Employment Practice. He has been with Miller & Martin since 1985 and concentrates his practice primarily on employment law, corporate/commercial litigation and federal agency investigations. He advises employers with respect to minimizing exposure in connection with reductions-in-force (RIFs), workforce restructurings and day-to-day employment issues. He assists employers in designing, implementing and enforcing alternative dispute resolution (ADR) programs, including mandatory pre-dispute arbitration agreements. He also advises clients on conducting corporate and workplace investigations, including federal and state agency investigations. In connection with commercial litigation, he is lead counsel for the FDIC as receiver of a number of failed financial institutions in connection with multi-million dollar commercial disputes as well as professional liability investigations, lawsuits and related insurance coverage issues. He has handled insurance coverage disputes pertaining to D&O insurance and fidelity bond claims. Chuck also is a Rule 31 certified civil mediator and has served as an advocate in over 100 successful mediations. He received his J.D. from the University of Georgia School of Law.

Stacie Caraway is an employment law strategist, litigator and trainer, advising national, regional and local employers on employment law matters focusing on FMLA leave administration, ADA, pregnancy and religious accommodations, as well as anti-harassment, discrimination and retaliation laws. She develops, reviews and updates employee handbooks, policies, employment contracts and severance agreements, and represents employers in local, state and federal legal proceedings including the EEOC, DOL and state human rights commission investigations, mediations and lawsuits throughout the United States. Stacie is a frequent speaker at national, regional and state HR, executive and management forums regarding the above-described topics, and provides in-house training and counsel to HR professionals and supervisors to help them address various issues relating to employee hiring, discipline and termination which impact companies of all sizes. Stacie received her J.D., with Honors, from the University of Cincinnati College of Law and a bachelor’s degree from the University of Tennessee at Chattanooga.

Attorneys at the Bar - What Happens When you Mix the Practice of Law with Alcohol. The ACC Georgia Chapter welcomes Drew Eckl & Farnham, LLP whose attorneys Robert Welch and David Rusnak will present “Contract Management in Times of Crisis: Solving Real World Problems the Right Way”.  This webinar will examine a series of scenarios any business could encounter with its contracts during the COVID-19 crisis, and provide practical guidance on how to manage them in real time, without making missteps that could cause headaches after the crisis ends.

The ACC Georgia Chapter welcomes Ogletree, Deakins, Nash, Smoak & Stewart, P.C. whose attorneys Ruth Anne Collins Michels, John Morrison, Shontell Powell, and Amie Willis will present “Challenges Employers Face as Employees Return to the Workplace”.

The firm’s L&E Group’s discussion will include a brief update on Georgia’s Shelter-in-Place Order as well as:

  • Georgia unemployment issues specific to employees returning to work
  • Best practices for recalling furloughed employees (or rehiring laid off employees)
  • Key considerations for developing a return to work plan
  • Leaves of absence laws and potential accommodation issues

Among the topics that will be discussed by the ERISA Group are how returning to work affects 401(k) plans, health plans and other employee benefits.  In addition, the group will discuss the implications for incentive compensation arrangements as uncertainty about the effects of Covid-19 continues.

The OSHA Group will cover the most common OSHA issues as it relates to COVID-19 including OSHA’s recommend safety protocols; reporting and/or recording COVID-19 cases to OSHA; differences between face coverings, facemasks, and respirators; and working from home (i.e. what happens if an employee is injured while working from home).

As states begin to allow businesses to unlock their doors, with some states opening up sooner than others, General Counsels and Chief Legal Officers are now facing new challenges establishing return to work policies, assessing business operations, and ensuring a safe workplace – with the potential threat of employer liability lurking in the shadows.

We know that you are most likely being bombarded with messages about the Coronavirus, whether that be on television, social media, or in your community networks.  At uncertain times like this, anxiety, stress, fear and negative thoughts can easily take control.  You may be worried about being in crowds, your loved ones, your seniors, your office, your clients, your finances or how to manage isolation.

Recent studies have shown that there has been a dramatic increase in impairment due to alcoholism, addiction and mental health disorders among members of the legal profession. The statistics are compelling and clearly indicate that 1 out of 3 attorneys will likely have a need for substance use or mental health services at some point in their careers. Accordingly, unexpected events like those we are facing as a society will have an even greater impact on lawyers and those who work with them.

In light of this unprecedented crisis and it’s far reaching impact, Mr. Quinn will discuss:

  • The prevalence rates of impairment in the legal profession due to substance use and mental health issues
  • Causes and symptoms of depression, stress and anxiety
