The ACC Georgia Chapter welcomes Ogletree, Deakins, Nash, Smoak & Stewart, P.C. whose attorneys Ruth Anne Collins Michels, John Morrison, Shontell Powell, and Amie Willis will present “Challenges Employers Face as Employees Return to the Workplace”.

The firm’s L&E Group’s discussion will include a brief update on Georgia’s Shelter-in-Place Order as well as:

  • Georgia unemployment issues specific to employees returning to work
  • Best practices for recalling furloughed employees (or rehiring laid off employees)
  • Key considerations for developing a return to work plan
  • Leaves of absence laws and potential accommodation issues

Among the topics that will be discussed by the ERISA Group are how returning to work affects 401(k) plans, health plans and other employee benefits.  In addition, the group will discuss the implications for incentive compensation arrangements as uncertainty about the effects of Covid-19 continues.

The OSHA Group will cover the most common OSHA issues as it relates to COVID-19 including OSHA’s recommend safety protocols; reporting and/or recording COVID-19 cases to OSHA; differences between face coverings, facemasks, and respirators; and working from home (i.e. what happens if an employee is injured while working from home).


Speakers

Ruth Anne Collins Michels practices exclusively in the area of employee benefits law. She represents clients in the areas of qualified retirement plans, health and welfare plans, fiduciary compliance best practices, nonqualified deferred compensation plans, ERISA compliance, COBRA administration, HIPAA privacy regulations, and compliance with other federal laws relating to employee benefits matters, including the Affordable Care Act.

John Morrison is the team leader of the firm’s executive compensation practice.  His practice encompasses all aspects of executive compensation and employee benefits, focusing on the design and analysis of executive compensation arrangements and related corporate governance and disclosure matters. John has extensive experience advising on executive compensation and employee benefit issues in connection with mergers and acquisitions; corporate restructurings; and financings, including change of control and retention agreements and golden parachute excise tax mitigation strategies. John also has extensive experience advising multinational public companies and private companies, and tax-exempt organizations on a wide range of executive compensation matters.

Shontell Powell focuses her practice on occupational safety and health law, assisting employers nationwide in enforcement matters before the Occupational Safety and Health Review Commission and state plan review boards and whistleblower complaints under various statutes including the Occupational Safety and Health Act (OSH Act) and the Surface Transportation Assistance Act (STAA). She also advises employers on a wide variety of occupational safety and health issues including injury and illness recordkeeping, post-accident drug testing, safety incentive programs, combustible dust, lockout/tagout, machine guarding, fall protection, bloodborne pathogens, workplace violence, and heat stress. She also represents and advises clients during the development and implementation of new OSHA laws and policies.

Amie Willis has practiced law since 1996 and joined Ogletree Deakins in 2009. She has gained extensive experience in employment matters representing employers across the country in a wide variety of industries, including school districts and municipalities, manufacturing, hospitality, technology and health care.  Since 2005, Amie has primarily represented large and small health care clients in New Mexico and Georgia.  While Amie provides client counseling and training on a wide variety of topics, she also litigates civil cases on behalf of employers in state and federal courts, and before the New Mexico Human Rights Bureau.

Attendance is limited to ACC members and their invited in-house counsel guests, as well as prospective ACC members.  ACC membership is open to attorneys who practice law as in-house counsel employees of organizations and who do not hold themselves out to the public for the practice of law.
