This presentation will provide a practical discussion of workplace and employee relations considerations as businesses begin to reopen and more employees are asked to return from unemployment, furlough or working at home amid the COVID-19 pandemic. Please forward the link to this informative program to the HR professionals in your company! The discussion will include:

• Unemployment benefit issues, including potential conflict between the Families First Coronavirus Response Act enhanced unemployment benefits and CARES Act Paycheck Protection Program requirement that furloughed employees return to work;

• Leave issues/traps with new leave laws and the FMLA;

• Avoiding age related remarks/discrimination;

• Employee privacy (ADA and HIPAA);

• Worker’s compensation and other insurance coverage issues;

• Executive orders by governors, mayors, etc.;

• Local ordinances;

• Workplace health and safety guidance;

Chuck is Vice-Chair of the firm's Litigation Practice and Co-Chair of he firm's Labor & Employment Practice. He has been with Miller & Martin since 1985 and concentrates his practice primarily on employment law, corporate/commercial litigation and federal agency investigations. He advises employers with respect to minimizing exposure in connection with reductions-in-force (RIFs), workforce restructurings and day-to-day employment issues. He assists employers in designing, implementing and enforcing alternative dispute resolution (ADR) programs, including mandatory pre-dispute arbitration agreements. He also advises clients on conducting corporate and workplace investigations, including federal and state agency investigations. In connection with commercial litigation, he is lead counsel for the FDIC as receiver of a number of failed financial institutions in connection with multi-million dollar commercial disputes as well as professional liability investigations, lawsuits and related insurance coverage issues. He has handled insurance coverage disputes pertaining to D&O insurance and fidelity bond claims. Chuck also is a Rule 31 certified civil mediator and has served as an advocate in over 100 successful mediations. He received his J.D. from the University of Georgia School of Law.

Stacie Caraway is an employment law strategist, litigator and trainer, advising national, regional and local employers on employment law matters focusing on FMLA leave administration, ADA, pregnancy and religious accommodations, as well as anti-harassment, discrimination and retaliation laws. She develops, reviews and updates employee handbooks, policies, employment contracts and severance agreements, and represents employers in local, state and federal legal proceedings including the EEOC, DOL and state human rights commission investigations, mediations and lawsuits throughout the United States. Stacie is a frequent speaker at national, regional and state HR, executive and management forums regarding the above-described topics, and provides in-house training and counsel to HR professionals and supervisors to help them address various issues relating to employee hiring, discipline and termination which impact companies of all sizes. Stacie received her J.D., with Honors, from the University of Cincinnati College of Law and a bachelor’s degree from the University of Tennessee at Chattanooga.
