This CLE will provide updates on the changes implemented and expected to be implemented by the Biden administration. This CLE will also preview employment cases that the United States Supreme Court will likely consider in its upcoming term.

Managing Your Company’s Environmental Legal Risk:
What You Need to Know

Presented by: Ally Cunningham, Lathrop GPM Environmental & Tort Partner, and
Sarah Lintecum, Lathrop GPM Insurance Recovery & Counseling Associate

Moderated by: Mara Cohara, Lathrop GPM Environmental & Tort Practice Group Leader

Wednesday, April 7, 2021

12:00 PM – 1:00 PM via Zoom Webinar
The Zoom link for the meeting will be included in your registration confirmation email.

 Program Description:

If your business manufactures products or produces services that are subject to environmental regulations at the federal, state or local levels, insurance coverage is certainly one tool you use to manage and mitigate your environmental legal risk. However, many businesses do not take full advantage of their insurance coverage in mitigating their environmental risks.

Lathrop GPM Environmental and Insurance Recovery attorneys will cover the essentials of environmental risk management in this presentation, including reviewing areas of environmental liability and risk (most businesses have some) and recommended steps for filing environmental claims with insurance companies – from figuring out which policies apply to providing best practices for claim notice and claim resolution. Then, we will discuss some of the most common coverage issues for environmental claims.

PFAS (per and poly-fluoroalkyl substances), which are often referred to as “forever chemicals,” can now be found everywhere, from drinking water supplies, to consumer goods and personal care products. It’s even found in 97 percent of Americans’ blood. The durability of forever chemicals has led to their ubiquity in modern life. But what makes them so useful also means that when they get into water, land and food supplies, they can stay there for decades. Lathrop GPM attorneys will give a short overview on the regulatory landscape, legal issues surrounding PFAS, and risks faced by companies where PFAS has entered their supply chain, as well as insurance considerations.

 Topics Include:

  • Types of environmental risks (10 minutes)
  • Tips for filing environmental insurance claims (15 minutes)
  • Common coverage issues (20 minutes)
  • Introduction to PFAS, an emerging contaminant (15 minutes)
