9:00 a.m. to 10:00 a.m. - Session I - Anderson Kill presents: “How to Manage the Expense of Litigation to Maximize Recovery from Insurance Companies and Third-Parties”

Very often, transactions and the interests that drive them, are lead by the business side of a company.  When litigation arises, whether because of an accident, natural disaster or other event, it is typically left to the legal department to explore and maximize all available remedies and ultimately protect the company (while preserving important relationships with counter-parties).  In-house litigators must manage the P&L statements of litigation, litigating efficiently and maximizing the offset of any loss.  

This session will guide in-house counsel on ways to protect the company’s rights and pursue recovery from counter-parties, draft contracts with an eye to reducing post-loss disputes and their expense, and identify key provisions and strategies to help maximize recovery after a loss – both from counter-parties, their insurance, and yours.

With arbitration being preferred by most to resolve commercial disputes, this program will go over the pros and cons of arbitration.  Our presenters will outline some strategies and pitfalls companies should be aware of when deciding who, when, and why to arbitrate leaving attendees with practical takeaways to consider when designing an arbitration process to accommodate their respective company’s business objectives.

The last few years have witnessed a sea change in ability of corporate clients to protect their confidential information through confidentiality agreements and orders in litigation. While it used to be a reasonably safe assumption that, at least until trial, documents that a corporate client regarded as confidential could be kept out of public eye, recent developments make it substantially more likely that confidential documents and information will become public more often and at earlier stages of the litigation process. These developments have important, underappreciated implications both for companies weighing litigation and for transactional counsel considering arbitration requirements and forum selection clauses.
