Employment Law Hot Topic: Employment Law Ethics for In House Counsel

This presentation will feature the most common ethical pitfalls that arise for in-house counsel in the employment context and cover various fact patterns and how best to navigate potential conflicts while representing the company in connection with employment-related issues and disputes.

Whether clients are facing regulatory obligations, e-discovery and other litigation costs, privacy risk, or increasing cyber threats, the financial and reputational impact of keeping legacy data and paper documents beyond their operational life has hit a point of critical mass. In this program, our experts will discuss the ethical obligations attorneys have to counsel their clients on effective data retention and disposition in order to comply with the duties of competency, confidentiality, expedition, candor, and fairness.

Synopsis: Whether it takes the form of a threatened litigation, a government subpoena or a whistleblower complaint, companies must move quickly to investigate and assess the threat, and ensure relevant information is preserved. This presentation will cover scope and timing of document preservation, considerations when retaining counsel for the company and employees, gathering facts through employees interviews while protecting the privilege, and cooperation with government investigations.

This program is pending approval for 1 Ethics CLE credit in WA. To receive CLE credit, you must sign in and out of the attendance sheet.

This year, we are partnering again with the Corporate and Regulatory Compliance Program at the University of Connecticut Law and Business schools to bring our community a terrific mix of topics, with thought leadership and plenty of practical advice. 

We have representatives from government, academia, outside law firms, consulting, and area organizations who will be sharing their current thinking on what it takes to have an effective compliance program and where companies should be focusing their efforts given regulatory and enforcement priorities.  The Compliance Conference also will introduce new approaches to assessing Legal and Compliance Risk and bring active discussion around how to build a strong culture of compliance in today’s diverse and hybrid workplace.

This interactive workshop facilitated by LK will explore in-house counsel’s role in responding to legal and ethical issues arising from conflicts and other difficult situations that might arise in an organisation. 

Through a case-study that will guide our discussion, we will use the collective wisdom and experience of attendees to delve into some of the legal and ethical issues that in-house counsel may face or be required to address when a technical or organisational conflict arises.  We will explore the impact of culture on critical decisions by in-house teams, and consider obligations under the Solicitor Conduct Rules, and how they guide and impact upon decision-making.

This session will form the first of a two-part series on the impact of conflict with a Breakfast Briefing to follow that will look at techniques for addressing and resolving conflict within the workplace.
