As our employers’ representatives, we are expected to seek the best outcome we can achieve, whether that be in contract negotiation, enforcement of rights or in litigation. But we are also officers of the court, with a paramount obligation to ensure the interests of justice are served. Drawing the line between taking a tough approach in advancing an employer’s interests and a lawyer’s professional duties is not always easy.

Our experienced litigation lawyers will explore the duties owed by lawyers in this context covering the following:

•    the ethical framework and issues that arise for in-house lawyers in representing their employer’s interest
•    whether lawyers are placed at a disadvantage by having professional obligations that others may not have
•    the legal implications – unconscionable conduct under the ACL and misleading conduct
•    the use that may be made of statements made in (and knowledge gained from) without prejudice discussions
•    frankness in dealing with regulatory authorities
•    case studies on the above

This session is relevant for all in-house counsel roles.

Ethics at the Improv! It's no joke! The ACC-WI Annual 3.0 Hour Ethics Seminar is back and this year it will be a little different. Social media has disrupted the marketing landscape and plays an integral role in how a company communicates with its audience. It’s a key strategy for businesses to attract customers, seek customer feedback, build brand recognition and loyalty and increase market reach.

Establishing guiding principles around company social media use is critical to ensure that your message is aligned to your company values, and your employees understand their roles and responsibilities.

What are the implications to your organisations should there be a breach of your company social media policy, how do you navigate these complexities with staff, as well as managing any reputational damage?

Join panellists Simon Hatcher, Hughes Public Relations and Communication Counsel, Rebekah Venning, Legal Counsel at University of Adelaide, and Emily Haar, Senior Associate at Piper Alderman for this breakfast seminar which will explore the use of social media within an organisation, and discuss some of the common legal issues, including:

  • Revealing Confidential Information. The most common yet the most dangerous legal issue with regard to social media, is the disclosure of confidential information
  • Illegal Use of Trademarks
  • Defaming Problems
  • Ambiguous Posts on Social Media
  • Illegal Use of Copyrighted Work

Participants are invited to bring their Marketing or Social Media Manager to this informative session. Please ensure you register both attendees.
