Managing Increasing Health and Welfare Plan Risk

 

In today’s complex benefits landscape, health and welfare plan fiduciaries face increasing scrutiny and responsibility. Plaintiffs’ firms are actively looking for potential employee plaintiffs who participate in group health plans. In addition to civil litigation, the DOL has increased its investigation activity in the health plan arena. In-house counsel needs to know how to manage these risks. One way to insulate the Board is to establish a health and welfare plan fiduciary committee to conduct formal, well-documented processes to monitor health plan activities and service provider performance and fees. This presentation will explore best practices for fiduciary governance.

This session will explore how recent federal legal developments and judicial scrutiny of Diversity, Equity, and Inclusion initiatives are shaping broader conversations about justice, fairness, and legitimacy within the U.S. legal system. Presently, there are competing interpretations of what is lawful in the DEI landscape—the law says one thing, public opinion says another, and the presidential administration has issued executive orders and agency directives seemingly intended to change the law. As courts increasingly weigh in on the constitutionality and legality of DEI-related employment practices, in-house counsel must not only ensure compliance but also understand how these legal outcomes influence public perceptions of fairness and the credibility of the judiciary. In-house counsel is at the forefront and, with a rapidly evolving legal and public opinion landscape, compliance in this area is rife with legal and ethical issues, both under the law and the rules of professional conduct. In today’s environment, corporate crises are increasingly public, high-stakes, and fast-moving. From data breaches to leadership misconduct, in-house counsel must play a leading role in crisis preparedness and response. This includes managing legal risks while also protecting the company’s reputation and brand equity.

This one-hour CLE webinar, designed for in-house counsel across industries, offers practical guidance on managing two common but complex crisis scenarios. Legal, communications, and HR experts will share real-world insights and strategic frameworks for leading through disruption.

Part One of the program focuses on how to respond to cybersecurity breaches. Topics include how to work effectively with both internal and external communications teams. Attendees will learn how to:

  • Engage internal communications early to maintain consistency and control.
