Managing Increasing Health and Welfare Plan Risk

 

In today’s complex benefits landscape, health and welfare plan fiduciaries face increasing scrutiny and responsibility. Plaintiffs’ firms are actively looking for potential employee plaintiffs who participate in group health plans. In addition to civil litigation, the DOL has increased its investigation activity in the health plan arena. In-house counsel needs to know how to manage these risks. One way to insulate the Board is to establish a health and welfare plan fiduciary committee to conduct formal, well-documented processes to monitor health plan activities and service provider performance and fees. This presentation will explore best practices for fiduciary governance.
