Companies are increasingly called upon to navigate the important distinctions between the US and Canadian approaches to trademarks, patents, and data privacy. In this session, IP and privacy lawyers and in-house counsel will address some of the most pressing cross-border IP and privacy issues from a practical, “what do I need to know?” perspective.

The panelists will discuss commonalities and differences between the US and Canadian patent and trademark systems, and how these influence strategic decision-making with respect to patent and trademark portfolio management and enforcement respectively. The panelists will also explore trending cross-border privacy law issues, including: (1) how to figure out what Canadian privacy law(s) apply to your company, (2) what to know about cross-border data transfers to and from Canada, and (3) Canadian privacy law trends.

Stakeholders at every level increasingly expect a company to demonstrate a strong commitment to ESG through its business practices.  Responsibility for drafting and updating dynamic ESG-related policies, as well as overseeing implementation and compliance of mandatory disclosure and voluntary reporting is a small, but important, facet of the in-house counsel’s role.

Counsel’s holistic perspective across an organization allows insight into legal risk associated with making, measuring, upholding and communicating ESG commitments. Involvement of the general counsel and staff is essential to manage corporate risk.  This discussion will offer some principles for good ESG practices from a legal perspective.

Presented by Stacey Mitchell, Partner and Kenneth Markowitz, Consultant, at Akin Gump Strauss Hauer & Feld LLP, Patrick Samsel, Corporate Counsel, Director of Contracts and Legal at Fors Marsh Group and Kathleen Ambrose, Vice President, Global Government Affairs and Corporate Responsibility at TE Connectivity.

“Hindsight is 20/20” encapsulates the idea that things are easier to see or understand after they have already happened.  20/20 hindsight will be the theme of this ethics CLE, which will include looking back with 20/20 hindsight on things that got lawyers into trouble and looking back over the year 2020 and how its extraordinary events intersect with lawyer ethical obligations.  With the benefit of hindsight, this CLE will address:
· Lawyers in trouble in the headlines and the related ethics issues;
· Ethics issues underlying 3 of the top causes of loss according to lawyer malpractice insurers (mistakes, fraud and misrepresentation, and conflicts of interest);
· Ethics issues at the forefront of the pandemic (teleworking, confidentiality, and UPL issues); and
· Ethical obligations considered relative to the social justice movements (harassment and discrimination as misconduct and pro bono obligations).

A health pandemic creates a multitude of health and mental stressors that impact us as individuals. Employers may find they have more employees experiencing challenges with elder care and child care.  Additionally, the added mental stress can lead to an increase in alcoholism, drug abuse, domestic violence and depression. On top of this, multiple pharmaceutical companies are working on a vaccine. Some employees are ready to take the vaccine, some are not. And in the middle of all of this turmoil, employers are trying to safely bring employees back to the workplace. The ACC Georgia Chapter welcomes Taylor English Duma LLP whose Partners, Glianny Fagundo and Raanon Gal will present “Employee Health Challenges During a Pandemic – It’s More than COVID-19”. We’ll discuss what the responsibilities of Georgia employers are related to federal and state laws when these challenges arise and/or start to impact employee performance.

If your organization does business in California and you have been following the CCPA, you have undoubtedly spent a significant amount of time preparing for the CCPA’s arrival.
