For years, employers have been exploring the possibility of how automated tools (ranging from basic computer screening methods to advanced AI systems) may be able to improve and simplify the hiring process and other employment-related evaluation processes. And now, with NYC Local Law 144 going into effect in 2023, the new frontier of algorithmic decision-making in the workplace – and regulation of the same – is upon us.

NYC Local Law 144 is the most robust law regulating “automated employment decision tools” (AEDTs) to date, and it prohibits employers from using AI in employment decision-making processes unless they take a number of affirmative steps prior to doing so, including a bias audit of the tool. A key aspect of this bias audit is that it can also serve to enhance an employer’s attainment of its diversity, equity, and inclusion goals by ensuring that the use of AEDTs does not foster unintended bias or create unintended workforce disparities.

Making Pro Bono Work in a Virtual World

Remote representation is here to stay and can feel even more intimidating and unique in the pro bono setting. Join the Association of Corporate Counsel National Capital Region and Washington Council of Lawyers as we invite an experienced panel of in-house volunteers and legal service coordinators who will share best practices, lessons learned and tools for success that enable pro bono volunteers to navigate all aspects of virtual client representation, including clinics, limited scope representations, and even remote court proceedings.

Will your D&O insurer step up to defend your company if it receives a Department of Justice subpoena? Government subpoenas are often unexpected and require a swift and sometimes costly response. To add insult to injury, insurance companies can be quick to deny claims made under D&O policies. The language of the subpoena, the terms of the policy and the governing law all affect whether a claim should be paid. Our panel will examine the contractual language most likely to give rise to a coverage dispute and how your company can best position itself to prevail. From a coverage perspective, we will also provide an overview of what to expect when you receive a government subpoena or similar investigative inquiry, how D&O policies are triggered in this context, what to do when a claim is denied, and how to maximize coverage for the costs ultimately incurred.

Currently, State legislators are in a battle with the Federal Government to limit the effect of the Federal Arbitration Act’s broad sweeping policy of enforcing arbitration agreements and class-action waivers. Society, businesses, and workforces are rapidly becoming more complex, unpredictable, and risk-laden. GCs must be key thought partners, decisionmakers, and stakeholders within the inner circle of leadership to guide organizations. GCs and legal departments must be engaged with business leadership and cannot afford to provide counsel from a distance or after the fact. Nor can GCs rely on traditional facetime to train and develop legal teams. We will explore how the GC role is changing in these ways:

  • Becoming more central and indispensable to key strategy discussions, early decision-making, and direction-setting 
  • Demonstrating more diversity in demographics, career path, and experience, reflecting increasingly diverse workforces as well as contributing broader perspectives in the C-suite
  • Developing more proactive advice and leadership in counselling organizations, defining how legal work is performed in hybrid environments, developing legal team interpersonal competencies, and team-building.
