The Commodity Futures Trading Commission (CFTC) announced in October 2022 that 20% of its enforcement actions for the 2022 fiscal year dealt with the crypto industry. Understanding how crypto works and where the next issues may arise will be a key part of doing business in 2023. Our panel will discuss the CFTC enforcement process and focus, where the Securities and Exchange Commission’s and other regulators’ jurisdiction overlaps, and a working foundation on crypto assets.

In industries where intellectual property (IP) constitutes the bulk of a company's value, the strength of its patent portfolio can make or break its prospects for continued success. When millions of dollars or even entire businesses are at stake, IP due diligence is essential to determining the full value of the IP involved, to assessing and evaluating the risks, and to determining whether the transaction is in each party's best interests.

During this "Efficient and Effective IP Due Diligence" presentation, Fish attorneys Jason Zucchi and Craig Deutsch share tips, tricks and things to consider when undertaking IP due diligence. Jason and Craig will discuss

If structuring and negotiating international transactions is not difficult enough, the intricate web of U.S. laws and regulations that govern the export of goods and services are complicated, fraught with risk, and enough to make the most sophisticated in-house lawyer’s head spin. We will simplify and distill these laws and regulations and provide simple and straightforward guidance on how to pragmatically approach the export licensing process.

Everything from export classification, to the licensing analysis, to exceptions and exemptions, to the various licensing vehicles offered by the Directorate of Defense Trade Controls at the U.S Department of State and the Bureau of Industry and Security at the U.S. Department of Commerce, to the export license application process, and export license provisos will be discussed.
