More and more today’s lawyers do two things terribly wrong. They fail to account for and try to co-opt the strengths of their opponent’s case, believing their evidence will simply overwhelm the other side’s. Second, they do not tailor their trial presentation for the way juries’ think, which is in terms of gut justice and finding the ‘true story’ of what really happened. Instead, today’s lawyers think of trial like a debate where each side tries to ‘score points’ and the side with the most points wins. This is not how juries think. These two mistakes can spell catastrophe at trial. This CLE identifies red flags for in-house counsel to look out for that show their outside counsel are going down the wrong path in preparing the case for trial and how to achieve a course correction.

You are invited to attend our June CLE luncheon- in-person at Paesanos Lincoln Heights or via Zoom.

As focus shifts away from COVID-19, companies now confront a changed legal landscape under the employee-friendly Biden Administration with a noted uptick in the aggressiveness of various federal agencies.  The NLRB, EEOC, and DOL announced their intention to team up in combatting retaliation against employees, while the DOJ and FTC are targeting restrictive covenants, wage theft and misclassification cases. In addition to reviewing agency developments, Ogletree attorneys Larry Smith and Tiffany Cox Stacy will provide an update on key employment law developments both at the federal and state level, including issues of sexual harassment, arbitration agreements, and pay equity/transparency, as well as on recent court decisions.

Please feel free to pass this invitation on to other individuals within in your organization who would like to learn more about this subject!

The presentation will focus on the state of arbitration in California, particularly the enforceability of mandatory arbitration agreements and the litigation surrounding which matters can be compelled to arbitration and which claims cannot be compelled.  We will discuss class action wavers, PAGA – Viking River Cruise, AB 51, the Ending Forced Arbitration of Sexual Assault and Sexual Harassment Act of 2021, and CCP §§ 1281.97-1281.99 concerning arbitration fees and costs.

Unfair Competition and Trade Secrets – The Pitfalls of Commencing Litigation without Following Best Practices

In the current economic climate, professionals are changing jobs at record rates. This increased employee mobility oftentimes arises in litigation, especially where the employee leaves for a competitor and takes valuable company trade secrets without authorization. The success of this litigation, however, is highly dependent upon a company following important best practices both before a case is filed and during its prosecution or defense.

This program will explore important lessons learned – sometimes the hard way – from recent state and federal rulings. Attendees will acquire a better understanding of some of the key pitfalls that can sink a trade secrets misappropriation case, and how companies can avoid them. The program will provide practical advice in an informal breakfast setting and the presenters welcome and encourage interactive questions and discussion points.

Even well-managed companies are vulnerable to unforeseen circumstances and emergencies. A mismanaged crisis can result in significant and potentially irreparable damage to your business, financial stability, and reputation. In-house lawyers are frequently called upon to serve as a “voice of reason” to help assess the potential impacts of a crisis objectively and to work with the leadership team to mitigate legal, financial, and reputational risks. When dealt with effectively, these events can be a catalyst for improved performance and organizational growth, heightened relations with government agencies and improved brand perception.

The panel will talk through the issues, discuss the options, and provide practical advice on how to prepare for and lead your company and team through a crisis. In the current environment, all companies face increased vulnerability.
Learn tools to help you prepare for and assess a crisis situation and formulate a plan should such a situation arise for your company.

Presented by J. Steven Patterson, Partner at Hunton Andrews Kurth, Lyndsey Estin, Partner at Kekst CNC and Nicole Greenidge-Hoskins, Senior Vice President, General Counsel at the Human Rights Campaign and Human Rights Campaign Foundation.
