One of the newest areas of class actions is so-called “trap and trace” actions.  These actions relate to the use of common tracking tools (e.g., web pixels, beacons, cookies, etc.) on websites, and it seems that receiving a demand letter related to the use of these tools is not a question of “if”, but “when”.  In this CLE, we’ll discuss the origins of trap and trace claims, the laws and theories behind them, how to respond to these claims, and strategies for mitigating the risk of a trap and trace action being brought against your organization.

Defending Class Actions in Federal Court (3:10- 3:30)

This session will highlight practical strategies for defending class actions in federal court, with a focus on leveraging pretrial procedures to narrow claims, defeat class certification, and limit class membership.  

Unions and Emerging Trends (3:30-3:50)

This session will examine what’s happening at the National Labor Relations Board and will include a lively discussion about the uptick in unionization, emerging trends, tactics, and insights directly from the Acting General Counsel and current Board Members.  

Trump’s Effect on Federal Agencies (3:50-4:10)

This session will discuss the effects on federal agencies of the new administration and new agency leadership, including a willingness to be more action-oriented and less hesitant, at least on issues that are important to the administration, and willingness to take risks and adopt new and untested legal interpretations and positions.

 U.S. vs DEI (4:10-4:40)

“U.S. vs. DEI” will be a discussion on examining the current administration’s executive orders, agency actions, and litigation reshaping diversity, equity, and inclusion nationwide.

As the cyber risk to national security, economic security, and public safety has materialized in several high-profile events over the past few years and continues to evolve, all three branches of Government must find solutions to mitigate the risk. It’s an all-hands-on-deck situation. The U.S. Congress has moved rapidly to mitigate cyber risks through legislation; the Executive Branch has promulgated regulations, issued executive orders, and pursued public-private partnership. However, the U.S. Supreme Court reversal of the Chevron Doctrine in 2024 and articulation of the Major Questions Doctrine in 2022 threatens to slow down much of this progress and provides an opening for legal challenges where legislation is insufficiently clear, or executive branch agencies are perceived to be taking too much leeway in implementation decisions. This session will explore the myriad of implications on existing cybersecurity legislation and regulation with specific risk to important policy and rulemaking such as CIRCIA, breach notification rulemaking, TSA regulations, and water sector regulations.
