One of the newest areas of class actions is so-called “trap and trace” actions.  These actions relate to the use of common tracking tools (e.g., web pixels, beacons, cookies, etc.) on websites, and it seems that receiving a demand letter related to the use of these tools is not a question of “if”, but “when”.  In this CLE, we’ll discuss the origins of trap and trace claims, the laws and theories behind them, how to respond to these claims, and strategies for mitigating the risk of a trap and trace action being brought against your organization.
