According to the 2023 ACC Chief Legal Officers Survey, data security and privacy are among the most pressing issues currently faced by corporate legal departments.  At the same time, e-discovery is taking up an outsized share of litigation expenses, and we are now encountering new generative artificial intelligence that has the potential to reshape the ways companies do business—but that comes with its own set of legal and data concerns.  This program will discuss these challenges—and offer concrete suggestions for how to limit or eliminate some of the greatest legal risks.

Registration:   3:15 p.m. to 3:30 p.m.

Program:   3:30 p.m. to 4:30 p.m.

Networking Reception: 4:30 p.m. to 5:30 p.m.

This program has been preapproved for one hour of PA substantive CLE credit.

Please join ACC Northeast and Exterro for this important in-person event at Sam Adams Faneuil Hall, Boston.  The program will lay the legal foundation for new requirements under CA, CO, Utah and VA privacy laws, as well as evolving enforcement positions by the CA Attorney General, and examine data governance tools to help manage access rights and deletion requests, cookies and digital advertising, retention and destruction, and impact assessments and purpose limitations.

Key takeaways:

  • The new consumer rights and controller obligations;
  • The new contractual requirements for processors, service providers and contractors;
  • How to meet new retention schedule and limitation requirements;
  • Managing purpose limitations;
  • How the CA Attorney General views third party cookies.

Sharing sensitive data with ChatGPT for work, such as source code and meeting minutes, may be labeled a “data leak” due to fears that ChatGPT can disclose the data to the public once it is trained on the data. In response, many companies took action, such as banning or restricting access, or creating ChatGPT data disclosure policies. This resource from Seyfarth and Shaw discusses the implications of ChatGPT on trade secrets, disclosures, and provides key takeaways to consider with AI tools.
