Knowing when to pursue litigation (or not) and the implications of a lawsuit are often lessons hard learned by in-house counsel. This session will prepare in-house counsel on the key aspects of litigation including the financial impact of a lawsuit, how to leverage and manage outside counsel, and mitigating and resolving disputes as early as appropriate.

The first part of our three-part masterclass on settlement negotiations will examine the factors to be considered when evaluating claim or lawsuit settlement options, including the use of jury verdict research and additional potential options like mock juries and focus groups. The panelists will also offer tips on how best to coordinate with outside counsel to examine and implement your goals and settlement parameters in order to achieve a settlement that furthers the company's objectives.

Effective formal and even informal documentation is essential for ensuring clarity and legally secure business relationships. This one-hour CLE seminar will focus on the critical role of clearly documenting agreements and relationships to potentially avoid litigation. Attendees will gain valuable insights into practical approaches for drafting contracts with uncertainty and concurrent litigation avoidance in mind, establishing best corporate protocols, and maintaining detailed records. Implementing these best practices may enable attendees to better mitigate risks to avoid litigation or, at a minimum, create sufficient evidence to avoid trial by quick disposition of claims.
