The world has been turned upside down since the onset of the virus, and as the crisis continues, all employers are being faced with a multitude of new employment issues to navigate.

Geri Haight, Member, Mintz and former Vice President & Deputy General Counsel at Panera Bread, will lead this discussion and be joined by Amanda (Mandy) Carozza, General Counsel at The Rockport Company. They will provide up to date guidance and legal requirements that in-house counsel and employers should be aware of as they they navigate return-to-work plans for office spaces, the remote working environment, navigating leave policies and the ever-changing wage and hour landscape. They will also address the ongoing economic disruption caused by the pandemic and its impact on non-compete and non-solicit agreements and severance agreements.

This presentation will cover the complex considerations businesses should keep in mind regarding restrictive covenants and protection of trade secrets as they face the long-term implications of employing a more remote workforce.

  • Preventing trade secret misappropriation
  • Employee access/technology in remote work situations

Pennsylvania legalized medical marijuana in 2016.  The guidance for employers contained in the law left a lot of companies guessing with regard to compliance.  Finally now, some four (4) years later, litigation regarding employment-related aspects of the Pennsylvania Medical Marijuana Act (“PaMMA”) has arrived.  In this presentation, we will provide a brief overview of the PaMMA and its impacts on employers.  We will also discuss recent case law emerging in both Pennsylvania and beyond, providing some clarity to the vague areas of the statute.

Join us for a virtual roundtable discussion and virtual happy hour looking ahead to 2021 and the Labor and Employment Law issues and priorities on the horizon.

While we obviously want to steer clear of political debates, arguments, talking over each other, vote/mask shaming, etc., let's celebrate the approaching end of 2020, and find out what changes we can look for in Labor & Employment Law in 2021.

Discussion includes:

  • Anticipated legislative agenda and priorities 
  • Executive Orders, including likely priorities for repeal and reissue
  • Likely priorities for the NLRB, EEOC, DOL and OSHA
  • Pending U.S. Supreme Court decisions, the new (un)balance on the Court, and potential packing of judges


We’ll have some fun and include polling/voting and enjoying a beverage of your choice (perhaps champagne in celebration of the election outcome, beer to cry into . . .)

Program Description: America faced a host of challenges in 2020, including a pandemic, political polarization, protests, natural disasters, a presidential election, the “Zoom” boom and our favorite – murder hornets. 2020 changed our way of life and the way most companies do business. This presentation will push past the noise and help employers focus on what to expect beyond the election and into 2021. We will discuss recommended changes to policy and practice, as well as issues in-house counsel should monitor as the year progresses.

   Discussion Topics & Objectives:

·       Anticipated post-election legal issues (for example, changes to federal agency priorities, anticipated legislative action) (25 minutes)

·       Recommended changes to employment policy or practice for early 2021 (for example, implementing/revising work from home policies, sick leave and PTO reporting) (25 minutes)

·       Labor and employment issues to watch in 2021 (10 minutes)
