Join us for a refresher on the basics of privilege and work product protection, including the application of Upjohn in the in-house setting. Following a review of the basic rules (using federal court case law and the ABA Model Rules), several everyday scenarios that are applicable to in-house teams will be reviewed, with a focus on practical guidance and a survey of recent key decisions in this area. E-mails and other electronic correspondence have long been problematic pieces of evidence for a litigator – both from the sheer size of electronic document productions and the potential for harmful admissions. This program will provide an overview of considerations related to e-mail and other electronic correspondence such as text messages, including considerations regarding the attorney-client privilege and how best to avoid putting damaging information into writing.
