Please join us on Wednesday, July 17th, to volunteer at a Nonprofit Legal Audit Clinic co-sponsored by the Colorado Lawyers Committee, the Colorado Nonprofit Association, the Association of Corporate Counsel—Colorado Chapter (ACC), Holland & Hart LLP, and Davis Graham & Stubbs LLP. 

Volunteer attorneys will:

· Network with other in-house lawyers from ACC and firm attorneys during continental breakfast.

· Enjoy a two credit CLE (1 ethics credit) on nonprofit law presented by lawyers from Davis Graham & Stubbs LLP and other organizations.

· Work on a team with other attorneys to meet with a small nonprofit and review a legal audit checklist. (You will receive the nonprofit’s materials in advance and CLE presenters will be available for specific questions.)

· Spend a morning to make connections, use your transactional skills, earn CLE credit, have fun, and make a difference.

The Art & Science of Mediation

Virtually every case will be mediated – either courts encourage “voluntary” mediation before trial or mediation is required as part of an arbitration agreement. There are multiple factors that come into play with every successful mediation. Please join Sarah Moffett and Setareh Ebrahimian of Fisher Phillips for a one hour webinar covering the art and science of mediation. They will take a deep dive into many of these factors, from selecting a mediator, preparing for mediation, and the opening session, to private meetings with the mediator and final negotiations, among others.

Avoiding Ethical Pitfalls Unique to Internal Investigations:  How to Protect Your Company (And Yourself!)


As experienced white collar & investigations practitioners know, internal investigations can be some of the scariest experiences for clients - whether this is the client’s first or tenth time to go through the process.  But besides the inherent emotional (and financial) toll investigations can take, in these days of heightened regulatory, enforcement, investor, and other stakeholder scrutiny, companies and their employees face real legal, financial, and operational risks if they do not stage and conduct these sensitive inquiries with a clear-eyed understanding of the ethical implications of their actions (and inaction).

Topics covered:  This presentation will cover the following topics/issues:

  • The importance of tailored and practical investigative work plans to ensure alignment and protect applicable privileges;
  • How to properly scope an investigation (and identify the actual client);

The National Capital Region and the Colorado Chapters of ACC are working together with Shook Hardy & Bacon LLP and Ankura Consulting Group to offer this special educational event on Extracting Electronically Stored Information from Requesting Parties & the Associated Ethical Obligations

 

When it comes to Electronically Stored Information (ESI) historically, plaintiffs have provided very little discovery, leaving large data holders at a disadvantage in one-sided litigation. These times are a-changin’. As plaintiffs communicate more frequently through social media and create highly relevant content, the scales are starting to balance. Attend this program to learn practical takeaway strategies on how large data holders can effectively act as requesting parties – therein balancing the scales.

 

This session will explore counsel’s obligations under ABA Model Rules 3.4, 4.1–4.4, and 8.4 when seeking to extract ESI from requesting parties, as well as the obligation of requesting parties’ counsel to be technologically competent pursuant to ABA Model Rule 1.1.  The goal is to get back to merits focused discovery – thereby limiting and reducing costs of the all-to-normal oversized discovery demands.
