Why we can no longer retain personal data forever in the MENA region & the impact of new laws on the retention & deletion of personal data

We are constantly being told that data is an asset. Every organisation is becoming a data company and the value of that data is increasing as ever more complex and sophisticated technologies are applied to derive insight and drive innovation. At the same time, we humans just love to retain and hoard data. Digitisation, cloud computing, evolving AI technologies and transformational ambitions are also contributing to an explosion in the quantities of data we gather, analyse and share.

As new compliance requirements like data minimisation, storage limitation, data subject rights and processor obligations begin to impact the lawful retention and deletion of personal data, the risk equation for data can quickly turn negative.

It's time to burn the undergrowth and plan for the future.

How do you apply a risk-based approach to data retention and deletion?

What will you learn:

• What are the legal obligations?

• What best practices or lessons learnt can we apply from beyond the MENA region?

• How do you operationalise efficient data retention and deletion?

Speakers are:

Dale Waterman, Managing Director, Breakwater Solutions (Moderator)

Ben Crew, Senior Director, FTI Consulting

Paul McCormack, Global Lead Counsel for Privacy and Cybersecurity, Saudi Aramco

This event is a collaboration between IAPP (Dubai chapter) and ACC Middle East and North Africa.

How do the new data protection laws and global best practices impact the consent management landscape across MENA in relation to the collection and processing of personal data?

How do you balance these new data protection requirements against those imposed by other existing laws?

Given certain similarities with APAC’s privacy culture, we will reflect on selected consent use cases and share different evolving risk-based approaches in B2B and B2C environments.

What you will learn:

• The complexity of consent (a 360-degree lens; legal, marketing, business model and operations)

• Data privacy is NOT only about consent!

• Developing, socialising and operationalising an effective consent management workflow

The webinar will be a panel discussion moderated by Dale Waterman, Managing Director, Breakwater Solutions. Panellists are Christine Khoury, Eversheds Sutherland and Shanthi Thangaraj CIPP/E, CIPM - Dubai Tourism.

Using hypothetical use case scenarios, we will deep dive into the fundamentals of Data Discovery and Records of Processing Activities (RoPA) by asking these key questions:

• Why it matters and is relevant to the MENA region?

• When should you start?

• How do you do it?

• What are the key focus areas, priorities, and risks to consider?

• Who are the key stakeholders?

What will you learn?

• Gain an understanding of data taxonomy

• How to leverage existing data discovery activities

• Data Discovery and RoPA operational workflow – how to prioritise high risk processing activities, cascade and communicate, mitigate, remediate, report and repeat.

The webinar will be take the form of a fireside chat between Manish Mishra, DPO at Masreq Bank and Noris Ismail, Managing Director, Data Privacy at Breakwater Solutions. It will be moderated by Dale Waterman, Managing Director, Breakwater Solutions, Middle East & North Africa.

Now that you’ve heard how to develop a plan to transform your law department operations and learned how to measure the impact of transformation from your peers, it’s time to take those learnings and put them into practice. This interactive session will focus on fictitious business scenarios that you will work through in facilitated breakouts. Be prepared for a unique and engaging experience that will help you better understand how to apply the lessons learned from sessions one and two to your own business.

After identifying a transformation initiative and securing the budget, the obvious next step is implementing it within your organization. While this may be difficult, the even greater challenge becomes how to produce tangible results that show the return on investment. How do you present the transformation journey success to the many stakeholders? Concurrently, how do you deal with the challenges and what didn’t work?

The session will provide attendees with concrete examples around:

• What defines success/failure?

• What is your return on investment? (KPIs, evidence based results)

• When will the savings be realized? (timeframe)

During this session you’ll hear lessons learned from several law department leaders throughout their own transformation journeys and will have the opportunity to discuss and share your own experiences in the subsequent breakout session. Regardless of your level of sophistication, this session will help you identify the best next steps to take in your own journey so that you can achieve your law department’s goals and be a better business partner.

The session will provide you with concrete guidance on:

• Where to start and how to prioritize transformation initiatives

• How to get buy-in on your plan

• Critical factors to address in order to increase your likelihood of success

• How to rebound when initiatives do not go as expected

75% of the world’s population will be subject to national privacy legislation by the end of 2023. That statistic will resonate strongly in the MENA region as we experience a tidal wave of new and updated data protection regulations. We are only three months into the year, and already there remains a clear message for all organizations: Are you ready?

In this launch event for our privacy series for 2022, we are delighted to confirm that J. Trevor Hughes, President & CEO of the International Association of Privacy Professionals (IAPP) will present a “keynote”, covering the following:

• Global data protection and privacy trends• How the evolving landscape is likely to impact the MENA region• How can we leverage the lessons learned from other jurisdictions as we localise privacy management and operations in MENA?

The webinar will conclude with a 15-minute Q&A session, facilitated by Dale Waterman, Managing Director, Breakwater Solutions.
