• Ensuring adequate language on pass-through claims in negotiated subcontracts (and that your contract managers and counterparts know what it means);
• Avoiding unintended waivers of claim under the Severin doctrine;
• Structuring and maintaining appropriate prime/sub roles during the claims process; and
• Nuances and traps for the unwary in pass-through litigation.

As the COVID-19 era changes and complicates workplace drug-testing considerations, this session will highlight practical navigation for emerging next steps.  It will feature an overview of different types of workplace drug tests, touching on the “who” (general employee population, specific positions, industry-specific considerations, etc.) “when” (pre-employment, for-cause, random testing, etc.) “where” (workplace vs. lab) and “how” (urine, hair, saliva, etc.)  Following that will be a deeper dive into state drug-testing laws and considerations for employers in PA, NJ and DE, as well as the pandemic’s impact on the drug-screening market and other areas related to workplace drug testing post-pandemic.

Remote work presents numerous employment challenges relating to such things as employee productivity, privacy of both employers’ and clients’/customers’ data, cybersecurity, time-keeping, and compliance with the Fair Labor Standards Act. During COVID-19 and beyond, employers will have to balance these concerns together with those relating to reintroducing employees to the workplace. This session will present perspectives on both sides of the equation, and provide employers tools to use in finding the right balance between remote and on-site work.
