The Biden administration is all-in on a “whole-of-government” approach to competition policy. On the heels of a wide-reaching executive order and appointments of Federal Trade Commission (“FTC”) Chair Lina Khan and Department of Justice (“DOJ”) Assistant Attorney General Jonathan Kanter, the government has threatened lawsuits across numerous industries under novel theories of antitrust harm. 

In this program, we will review the current antitrust landscape, the recent actions taken by the FTC and DOJ, and additional developments we anticipate from the agencies going forward, including anticipated effects on non-compete agreements, an increased volume of FTC investigations, and potential FTC rulemaking. We will hear the perspective of in-house counsel about how to navigate a company through these complex and changing issues, with an emphasis on how the changes impact your antitrust compliance program.

We will discuss these and other common issues that arise in a prime-subcontractor relationship, the importance of a well-drafted subcontract, review some case studies and provide real-world examples of the good, the bad and the ugly of contract drafting as well as provide our thoughts on best practices.
