Conducting Efficient Internal Investigations

Investigations are an important risk management tool in corporate counsels’ toolkit and are sometimes necessary to respond to government action. Spa Details

The spa is located on the 7th Floor of the Four Seasons Hotel. You are welcome to utilize all spa facilities before, between, and after your appointment(s) until 4:30 pm. Please bring your swimming suit so that you can enjoy the wet amenities, which include the outdoor heated pool, whirlpool tub, and steam rooms. Be sure to arrive at least 15 minutes prior to your service and be prepared to complete the Health Questionnaire online. Complimentary snacks and beverages will be provided. NOTE: No need to tip for your spa services, as the tip is automatically included.
Dress is business casual and all attendees will receive locker with Spa Robe.

The ACC Houston Chapter is proud to have Billy Newman as the 2023 Ethics Seminar speaker.


The Agenda for the 24th Annual Event will vary slightly from years past. With many upgrades for this 24th Annual event, we are thrilled to announce that our golfers will once again be able to enjoy Houston's premier PGA golf course, Memorial Golf Course.  This popular in-town muni sports fascinating green contours, modest but strategic bunkering, and acres of short-grass runoff around putting surfaces. The Original John Bredemus routing from 1936 has been tweaked some to make betters of the basically flat site, with lots of understory and trees removed to expose the ravines and make it spectator friendly for the PGA Tour's annual Houston Open. The work by architect Tom Doak was enhanced by consulting of 4-time major winner Brooks Koepka. Together, they have produced a golf course that tests everyday players and elite golfers alike.

Not to be outdone by golf, our spa attendees will see increased amenities and time at Trellis Spa at The Houstonian Hotel.  Trellis spa boasts as a Mediterranean style spa surrounding a courtyard that offers a beautiful, natural garden environment seen through large windows located throughout the spa.  In the newly renovated spa, our attendees will choose from massage, facial, manicure and pedicure treatments and we have added therapeutic treatments from The Covery by The Houstonian.  New treatments this year include Cryo-facial + Red Light Therapy, Infrared Sauna Therapy and Therabody Compression + Brain Tap. Also new this year, we are adding PICKLEBALL to the indoor racquet activities! As always, we will have tennis lessons with the pros at The Houstonian Club.  We will have yoga/pilates classes, as well. Additional Information

  • In the event we have more registrants than spa or tee times, we will do a random drawing to determine who will attend. All others will be placed on a wait list and will be notified as space becomes available.

  • Once we have done the drawing, participants that were picked for golf or spa will be sent an email with instructions on signing up. All other members will be notified of their status on the wait list. 

  • A $25 spa cancellation fee will be assessed if the cancellation of your spa reservation is received after 12:00 pm (noon) on Monday, February 29. You may avoid this spa cancellation fee if you designate a replacement prior to that time. Should any spa participant not show for her/his scheduled appointments, a $25 fee will be assessed to the "no-show" participant.

How Outside and Inside Counsel Can Partner to Improve Diversity

Law is the least diverse profession. And our profession's diversity numbers have been depressingly low since our profession began measuring them. We know that actions to date (committees, conferences, best practices, hiring initiatives, etc.) are not working. This means we need to evaluate additional actions in order to drive real change. Clients and judges--as nodes of power within our judicial system--have the opportunity to demand more. 

Recognizing that in-house counsel may face backlash for engaging in diversity-valuing behaviors, clients may first need to institutionalize their diversity goals, ensuring that in-house counsel know that they are responsible for meeting specific, measurable diversity goals when engaging outside counsel. In-house counsel can also be encouraged to create opportunities for diverse attorneys, facilitate their growth, and develop long-term partnerships. Judges can help ensure that young, diverse attorneys get opportunities for experiences within the courtroom, arguing motions, and taking witnesses at trial. But all of us must do more and think harder about ways to do better. The system won't change unless we do. This energizing program aims to give audience members real-life tools to achieve these aims.

 

Learning Objectives:

- Define the terms diversity, equity and inclusion and understand why the law is the least diverse profession.

- Recognize the hurdles that in-house counsel may experience when trying to engage and promote diverse outside counsel.

- Recognize five ways to make your teams more inclusive.

- Identify specific, measurable and challenging personal goals related to creating more inclusive litigation teams.

Earlier this year, San Antonio Legal Services Association (SALSA) was thrilled to recognize ACC of South/Central Texas with the Lee Cusenbary Impact Award for the association’s historic commitment to bolstering pro bono efforts in San Antonio. ACC’s annual support allowed the Community Justice Program (CJP) to transition to a larger, more robust pro bono entity, and SALSA looks forward to giving ACC membership an update about how far we’ve come and where we are headed. How to Conduct Effective Workplace Investigations

 Program Summary: In our increasingly “speak up" corporate environment, prompt and effective internal investigations enable businesses to take appropriate action to address issues raised in employee reports. Well-conducted internal investigations are also critical to reducing employment law risk and preventing legal liability, and they can boost employee morale and solidify corporate culture. Poorly conducted investigations, on the other hand, can create liability and dampen morale. Properly planning the investigation, conducting interviews that get to the facts, and carefully documenting outcomes are critical components of an effective corporate compliance function and are of vital importance in defending corporate decisions challenged in court.

Discussion Topics & Objectives:

This presentation will provide a step-by-step overview of a properly conducted and effective internal investigation:  

  • Identifying not only the right investigator, but also the role of the investigator, throughout the investigatory process (10 minutes)
  • Objectively characterizing allegations and planning the investigation, including determining its scope (10 minutes)
  • Understanding the investigator's role in gathering facts and evaluating evidence (5 minutes)
  • Conducting interviews that encourage participation, get to the facts, and demonstrate the company's dedication to the process (10 minutes)
  • Balancing the need to get the facts, give the accused a fair opportunity to respond, and ensure confidentiality and considering attorney-client privilege issues (10 minutes)
  • Drafting investigation reports and recommendations (5 minutes)
  • Responding to and evaluating common challenges/curveballs that may arise in investigations, including in the virtual context (10 minutes)
