In response to the COVID-19 pandemic, an increasing number of healthcare organizations are considering developing and launching telehealth platforms and businesses as a way to more efficiently, effectively, and safely provide care to patients across the country. Recent regulatory efforts at both the federal and state level have helped ease the path to the provision of services via telehealth, but organizations still face various legal and regulatory challenges in getting started. This roundtable discussion would be focused on critical corporate practice and structural considerations that organizations need to understand in order to successfully develop and implement a national telehealth platform.

Topics will include:
•    Rolling out a national telemedicine network
•    Understanding corporate practice restrictions
•    Mitigating corporate practice risks
•    Setting up a friendly Professional Corporation (“PC”) structure
•    Complying with state corporate practice prohibitions and avoiding the consequences

RETURN TO WORK – MANAGING NEW CHALLENGES IN THE WORKPLACE

COVID-19 has put unprecedented strain on organizations of all sizes across all industries. As employers adjust to the “new normal” in the workplace, they still face many challenges, including evolving legal obligations around COVID-related leave and workplace accommodation requests as well as issues related to employee off-duty conduct, travel and safety concerns and potential litigation. To properly navigate the complexities of these novel COVID-19 employment issues, you need innovative but practical solutions to mitigate risk and protect your most critical assets: people and reputation.

Our webinar will cover some of the key issues at the forefront of the workplace today, including:
•    Families First Coronavirus Relief Act (FFCRA) and Department of Labor (DOL) guidance on paid sick leave and family and medical leave requests
•    Accommodation requests, including remote work and extended absences
•    The current wave of COVID-related employment litigation and what to anticipate in the future
•    Employee noncompliance with social distancing guidelines provided by the US Centers for Disease Control and Prevention (CDC)

In this session, a BoyarMiller transactional attorney and litigator will walk through “problem areas” that often appear in acquisition documents. We will provide a dual perspective on how to issue spot through reps & warranties, definitions, confidentiality provisions, and more. Please join us on September 24th for a special round table discussion led by former federal prosecutor, Erica Giese, on the topic of "Civil Rights, Prosecutorial Discretion, and the Evolving Corporate Response to Misconduct." Erica will bring us a candid conversation about the ever-changing response to civil rights violations, investigations, and prosecutions. Learn about ways to respond if your business is embroiled in a civil rights or police brutality incident. Wendy’s, for example, became embroiled in the Raychard Brooks matter after Mr. Brooks was shot in the restaurant’s parking lot. The company likely suffered great reputational damage. Erica will bring us a view from both sides: law enforcement and victims. She has prosecuted and investigated numerous cases involving brutality by police. She has also declined to prosecute a few.
