Join us for an informational discussion on pending Texas House Bill 1875 on the creation of Business Courts in Texas. For the first time, all of Texas ACC members are invited to attend a webinar CLE together, thanks to the sponsorship of The Texas Lawbook.

With the goals of improving efficiency, predictability, and avoidance of pandemic-related delay in complex commercial litigations and fostering business in Texas, HB 1875 proposes that Texas join Delaware and 28 other states and create specialized business courts to handle sophisticated business litigations. Key panelists will be discussing the pros and cons of HB 1875 with moderator Mark Curriden of The Texas Lawbook. Attendees are encouraged to submit questions when they register, to be considered by the panelists.

ACC Houston Healthcare Law Practice Group CLE Webinar: The PREP Act
Asserting Immunity and Understanding Its Application For Health Care Providers
April 20, 2021 | 12-1 PM | 1.00 Hours CLE Credit (TX)

DESCRIPTION
The PREP Act authorizes the Secretary of Health and Human Services (HHS) to immunize private actors (including health care providers) from legal liability related to administering "countermeasures" (including authorized vaccines, COVID tests, and use of certain PPE) during the pandemic through 2024. But like all other laws promising immunity, a defendant seeking coverage of the Act must know how to apply the actual language of the Act to determine the scope of the immunity and how it might preempt other state and federal claims. This panel will analyze the Act’s language, recent HHS pronouncements and the state of the case law as well as address key controversies surrounding the law’s application.

PLEASE NOTE THIS CHANGE OF DATE
May 27, 2021 | 12-1 PM | 1.00 Hours CLE Credit (TX)

DESCRIPTION

Join Jonathon Hance as he answers some of the most frequently asked questions about identifying, safeguarding, sharing, and enforcing trade secret rights. During this interactive presentation, we will discuss practical steps you can take to protect your company’s data and information from misappropriation, to investigate potential misappropriation and breaches of confidentiality, to mitigate the impacts of misappropriation, and, if all else fails, to pursue litigation to enforce your rights.

Ms. Smart will discuss recent trends in professional responsibility and attorney disciplinary law particularly relevant to corporate counsel.  The presentation will include new statistics, case law and guidance on practicing ethically in the electronic age, as well as post-shutdown remote-work best practices applicable to corporate counsel.

An exceeding number of brand crises occur online and through social media.  Whether it's a disgruntled former employee, ill-advised tweet by a company executive, sensitive data breach, or unwanted attention from an online cohort like #WallStreetBets, your company will experience a digital crisis.  It's a matter of when, not if.  This presentation provides best practices for newly-minted and seasoned in-house lawyers in managing a digital crisis, and it explores the lessons learned from real life examples.

After a tumultuous year for employers and the country, Littler Dallas will offer insight into what this year and President Biden's administration may mean for employers. How will the course of labor and employment law be changed; and how can you help your company navigate these changes?

Specific topics will include:
* What do the election results mean for workforce policy?
* Where will the 117th Congress focus its attention in labor and employment policy?
* What administration workforce priorities and initiatives can employers expect in the coming year?
* What states will pursue a more aggressive labor agenda?
* How will the election results impact the labor agencies (DOL, NLRB, EEOC & DHS)?

This panel will discuss recent statistics, new norms, and best practices in M&A, labor and employment and commercial litigation during the pandemic and beyond.
