Over the past year, the legal industry has grappled with the evolving capabilities of artificial intelligence systems and how we might ethically deploy these powerful tools in our business and practice. Although many State Bars have now proposed or adopted ethical guidance on the use of AI systems in practice, most stop short of addressing how using AI systems can impact important protections for clients, including the attorney-client privilege. This presentation will explore current guidance on the ethical use of AI and considerations for protecting confidentiality and privilege.

The rapid spread of Artificial Intelligence (AI) systems in recent years has overlapped with the enactment of comprehensive privacy laws by U.S. states. Several of the comprehensive state privacy laws have provisions that specifically address certain uses of AI systems, in particular use in profiling.

This article surveys those provisions and assumes the reader is already familiar with basic concepts in the comprehensive privacy laws, such as controllership and applicability thresholds.

While the TDPSA was modelled after the Virginia Consumer Data Protection Act, there are differences that should be explored for entities doing business in Texas.
