Litigation funding is a means of covering litigation costs where a financing fund or hedge fund provides money upfront to a plaintiff or plaintiffs or their counsel in exchange for a portion of the proceeds from the litigation, primarily in consumer litigation or commercial litigation, which may include either single case arrangements or large multi-plaintiff cases or portfolio funding for law firms to handle multiple cases against companies just like yours. Knowing if a plaintiff or plaintiffs have litigation funding is crucial because it impacts the dynamics of the case or cases, influencing settlement strategies, the scope of discovery and risk assessment. Attendees will learn about the current status of objections to and efforts to regulate the growing litigation funding industry, and the various ethical concerns surrounding litigation funding which may benefit the corporate defendant. On the flip side, in recent years, corporations have executed strategies utilizing litigation funding to pursue damages for patent infringement and damages for antitrust violations in class action settings when it would otherwise be prohibitively expensive to pursue. This program will provide insights into how litigation funding is transforming the practice of law and shaping the future of dispute resolution.
