During this legal update, we will provide an overview of I-9 best practices and processes as well as what further actions could be rolled out during the Trump 2.0 administration. The presenters will also cover potential lawsuits that they expect to see as a result of increased I-9 audits and ICE raids, which may include workplace harassment by federal agents and 4th amendment issues, including unreasonable searches and seizures by the government.

In April 2024, with little fanfare, the EEOC changed its guidance on the standard for the adequacy of harassment investigations. Other agencies may follow suit. How do you protect the company, get the information you need, and stay ahead of the agency or other entity requesting the information? And more importantly, how do you keep your investigation from going off the rails? The speakers will discuss the legal and ethical pitfalls that can arise during an investigation, including how to protect attorney/client privilege and the company's responsibility for third party investigators.  Then, we will look at recent agency guidance and court decisions that establish the framework of a good investigation.

The recently ended Supreme Court term was regularly in the news for opinions related to policies of the current administration. While many of those opinions drew a fair amount of scrutiny and press, the most discussed of them are not likely to impact many employers. Nevertheless, there were several decisions that could have an impact on claims against employers, including the elements of establishing a claim for discrimination, claims under the Fair Labor Standards Act, and class actions. Christopher Hennessy, a litigation attorney with Cozen O’Connor, will discuss several of these cases and look ahead to the upcoming Supreme Court term for other cases where the Court’s opinion might have an impact.
