In April 2024, with little fanfare, the EEOC changed its guidance on the standard for the adequacy of harassment investigations. Other agencies may follow suit. How do you protect the company, get the information you need, and stay ahead of the agency or other entity requesting the information? And more importantly, how do you keep your investigation from going off the rails? The speakers will discuss the legal and ethical pitfalls that can arise during an investigation, including how to protect attorney/client privilege and the company's responsibility for third party investigators. Then, we will look at recent agency guidance and court decisions that establish the framework of a good investigation.
