Each year, numerous companies operating in California find themselves defending against high-stakes class action litigation—including lawsuits alleging damages from data breaches, products liabilities, wage-hour and other employment violations, and invasions of privacy. For insured companies facing such claims, liability insurance policies can help defray much or all of the expense associated with defending and resolving such claims.
In this presentation, insurance recovery partners from Pasich LLP will focus on ways in which companies can maximize their coverage for class action lawsuits and maximize the value of their liability insurance policies. Among other topics, our speakers will address notice and reporting requirements, the satisfaction of deductibles and retentions in the class action context, disputes concerning the selection of defense counsel, insurance coverage for class action settlements, and the evaluation of third-party indemnity agreements. In addition to addressing insurance coverage for a wide range of common law class action theories, the speakers will also discuss coverage for some of the most common statutory class action claims filed against California companies, such as those alleging violations of the California Labor Code and Private Attorneys’ General Act (PAGA), the Biometric Information Privacy Act (BIPA), the California Invasion of Privacy Act (CIPA), the California Consumer Privacy Act (CCPA), and California’s Unfair Competition Law (“UCL”), among others.
Your company’s liability insurance is one of its most valuable assets. This presentation will provide a high-level overview of the building blocks of a commercial liability insurance program, including general liability, D&O, E&O, employers liability/workers’ compensation, and specialty coverages. We will discuss key features and action items for occurrence-based and claims-made policy types and identify best practices for in-house counsel and risk managers to get the most out of your coverage.
