This is an interactive session focused on the fundamentals of energy law. Geared toward the non-energy lawyer, this session will walk through basic energy concepts, standard energy contracts and trends in energy law as they affect non-energy companies. The session will end with a mock contract negotiation and discussion of best practices.
Fracking sits at the intersection between US energy and environmental policy. It offers both transformative economic opportunities and energy security, as well as novel environmental regulatory challenges. This program will provide an overview of the key subsurface environmental and land use issues, as well as the regulatory and legislative efforts being undertaken at the state and federal levels, along with related litigation. Faculty for this program will consist of in-house experts who are responsible for fracking projects, outside counsel who have litigated fracking matters, and government attorneys who help develop and enforce regulations related to fracking.
Many businesses in local, national and international markets are starting to see the value of embracing green and sustainable values. This program will explore current U.S. Federal Trade Commission (FTC) green guides, the expanding scope of eco-labels, litigation on environmental marketing claims at the state level and recent FTC enforcement. Faculty will address key updates to prior green guides, new types of green claims, revisions to environmental benefit claims, guidance on the use of certifications and seals, areas where advertisers will have to change their current practices, and practical tips for compliance.
Every year natural disasters, such as hurricanes, floods, fires, earthquakes, and tornadoes, impose significant environmental harms, and many of these impacts are projected to increase as climate change accelerates. The emerging field of “disaster law” has a significant overlap with environmental law, both in responding to and managing the environmental impacts of natural disasters, and in the role of insurance and compensation in managing risks. This panel will review the legal components of disaster planning and disaster response, focusing on legal challenges that companies face in planning for disasters, ensuring continuation of operations in the face of disasters, and securing government assistance, regulatory relief, and insurance recovery in the wake of such disasters.
