Corporate responsibility has gained significant attention, leading to an increase in ESG disclosures and reporting across industries. Companies can leverage ESG considerations to ensure responsible operations and identify potential risks and opportunities that may impact sustainability goals. Kirstin Gruver, Deputy Chair of B&D’s Sustainability practice, will deliver an intro to ESG frameworks, the current disclosure landscape, and strategies for mitigating risk in this ever-evolving space.

Of the number of legal issues companies and their in-house counsel face in their day-to-day, environmental considerations may not be a primary focus.  However, with the recent uptick in enforcement and renewed focus on environmental policy and regulation at the local, state, and federal level, businesses who don't act to protect themselves could face potential legal ramifications: fines, lawsuits, and negative public perception as well as a possible risk to bottom line profitability.

Can companies collaborate in the interests of environmental sustainability agreements without breaching competition law in the UK? This important question is tackled by draft guidance published by the Competition and Markets Authority (“CMA”) on 28 February 2023 (“guidance”). The guidance sets out the CMA’s proposed approach to how agreements between competitors in relation to environmental sustainability will be assessed and aims to provide businesses with clarity and comfort on the CMA’s enforcement approach to encourage such initiatives to be progressed. The guidance aligns with the important role the CMA considers it has to play in tackling climate change, as noted in a recent statement by the CMA’s CEO on 25 January 2023.

Manufacturing processes for several industries use a family of synthetic chemicals called per- and polyfluoroalkyl substances (PFAS). Known as “forever chemicals” because they don’t naturally degrade, PFAS can be found in the water, soil, air, and human bodies—virtually everywhere in the world, even Antarctica.

Key industries with significant documented discharges include PFAS production and processing, metal finishing, airports, pulp and paper, landfills, and textile and carpet manufacturing.
