What do you do when you are handed control of the HR department? It is essential to keep up to date on various laws and policies. To meet this challenge, this session will cover RIF's, ERISA, WARN, cultural issues with foreign subsidiaries (which actually apply in the states), works councils, language, expatriates, data privacy, redundancies, benefits (national schemes versus local plans) and unions in the United States and in other countries.

This ACC Law Department Executive Leaders session included discussion of organizational structure, staffing and work allocation, outsourcing services, global considerations, and professional development.

Wage and hour issues can be significant sources of liability for any company. It is essential to keep up to date on these matters. This session provided an overview and update on federal and state wage and hour developments. It also reflected on best practices for dealing with those changes and provided practical advice for implementing them at your company.

Litigation of any kind is incredibly daunting for almost every defendant. The stigma, process, and potential costs associated with sexual harassment litigation can be especially harrowing. In this presentation audience members sat in the jury box and watched a DVD of a mock sexual harassment trial. The audience then was broken up into small groups with each “jury” asked to deliver a unanimous verdict and discuss the reasons behind their decision. This process showed corporate counsel which actions are the focus of jury deliberations and allowed them to participate in a jury trial.

ERISA is a complicated topic and opportunities to have it sorted out for you and the risks quantified are few and far between. This program did exactly that. It identified areas where many companies have deficient compliance programs and risk management, then offered practical solutions to address those challenges with a focus on adoption of best practices. The presentation focused on both regulatory compliance and discharge of fiduciary responsibilities.

You just got the papers. One of your company’s employees has filed a discrimination complaint with the EEOC. Now what? This is a first for you and your organization. Where do you begin? This presentation provided a brief background on the law of discrimination and wrongful termination. It also gave practical tips regarding investigations and other critical steps in-house counsel should take upon learning of such a complaint. Finally, the presenters provided tips on how to avoid such a situation in the future.
