Class and “collective” action lawsuits alleging violations of federal and state wage and hour laws continue to outpace all other employment law class actions. The USDOL recently estimated that the average litigation cost for FLSA cases concluded between 2012 and 2015 was $654,182 per case. This program will review the most frequent violations triggering wage and hour litigation, review the new proposed DOL overtime regulation, proposed DOL regulations regarding the calculation of the regular rate of pay, including exclusions for employer “perks,” significant court decisions, and wage litigation trends.
