It is easy to forget how critical ethical considerations are in internal investigations because many investigations are not conducted in connection with a court proceeding or government investigation. A  lack of formality opens the door for potential ethical lapses and that merits heightened vigilance. Most lawyers are well versed in ethical canons as they apply to litigation and dealings with the government, but may be less familiar with ethical obligations when handling internal investigations. In investigations, a number of ethical considerations are at play. Ethical issues can and do arise at every stage of an internal investigation. Anticipating ethical issues and devising a strategy for handling those situations can minimize risk to the client and bolster the credibility of the investigation. Thoughtful handling of ethical issues lends credibility to the investigative process, yields benefits in efficiency, and creates trust with the regulators.

Finding resources for innovation and legal operations is challenging, especially for smaller teams. There is often no budget and no headcount, and at first glance, some operational investments look like added costs.

Join us for an engaging panel discussion on building an effective business case for legal operations resources. This program will help you identify what can be measured in a legal department to demonstrate your value and drive change in legal processes and operations. We will discuss what to focus on first, what can be accomplished without dedicated legal operations personnel, how to show a return on investment in legal operations, and how to overcome challenges in legal departments with no resources available to focus on legal operations.

VW Bug. Nike Air Jordans. Oakley sunglasses. Ford headlamps. Viagra. Major companies have used design patents for more than a hundred years to protect their most important designs. But design patents are not just limited to these famous products—companies of all sorts use design patents to protect against counterfeiters and copycats, as well as to protect replacement parts revenue. With some of the highest stakes patent cases (like Apple v. Samsung) involving design patents, filing for design rights is an astute business precaution and portfolio strategy for even more modest budgets.

Please join our panel discussion with private and in-house practitioners to learn more about patenting designs across product lines, including graphical user interfaces, and their significance in overall business plans.

Topics to be addressed include:

  • Recent updates to U.S. practice, including changes associated with title amendments, possible solutions to USPTO printing issues, and the role of secondary considerations in design patent obviousness analysis
  • How design can be used by rights holders to combat counterfeiting
  • Overview of global design law, with five crucial distinctions to understand when filing design rights worldwide

Elizabeth Ferrill, Partner, Finnegan
Alexis Simpson, Senior Counsel, Gilead

While the term “audit” has a bad connotation, periodic IP audits are critical for the health of a business, whether the business is new or well-established. An IP audit begins with an inventory of the company’s current IP portfolio but also identifies IP that the company may have neglected to protect and enforce, IP that the company has not adequately maintained, and IP that the company may be able to monetize. Most importantly, an IP audit includes a critical review of the company’s IP strategies, practices and policies to minimize risk to the business, maximize the value of the company’s IP, and ensure that the company is effectively and efficiently managing its IP portfolio.
