Session 5: The In-House Lawyer’s Guide to E-Discovery and Data Preservation

As data continues to grow in complexity, so do the challenges of e-discovery.

This session will equip in-house lawyers with practical tools to manage this evolving landscape, including:

  • Navigating California and federal e-discovery rules
  • Implementing defensible data preservation strategies
  • Managing discovery costs and working with vendors
  • Addressing employee use of personal devices and off-channel communications

With data volumes exploding and technology constantly shifting, e-discovery has become a critical—and often costly—component of modern litigation. This webinar, the fifth in a six-part series, offers in-house counsel the essential knowledge and tools to save money and stay ahead of the curve. An experienced litigator will break down California and federal e-discovery rules, outline defensible data preservation practices, and provide strategies for managing vendor relationships and controlling costs. Attendees will also gain insight into one of today’s thorniest challenges: how to handle employee use of personal devices and off-channel communications. Whether responding to a subpoena or proactively building compliance protocols, this webinar will help in-house counsel navigate e-discovery with confidence and clarity.

Additional Session

July 30th | Session 6: Building a Winning Appeal Strategy – A Guide for In-House Counsel
In litigation, the trial is only the first act. It sets the stage, introduces the key themes, and delivers a verdict—but the story is not over. The appeal is Act II, where the legal narrative is tested, reshaped, and finally resolved.

Bringing in appellate expertise early, often before trial even begins, can be the key to preserving a victory or overturning a loss on appeal. From record preservation to issue identification, the appellate voice is essential to shaping a case with the endgame in mind.

In this practical session, certified appellate specialist Kendra Hall will walk through:

  • When and how to start preparing for appeal, including choosing the right appellate counsel
  • Preserving the record and avoiding waiver
  • The timeline for appeals in the California state and federal courts
  • Standards of review and identifying issues that offer the best chance of success
  • Real-world examples of successful appellate outcomes

Appeals aren’t just a legal afterthought, they’re a strategic opportunity to shape the final outcome of a case, and in-house counsel play a pivotal role in that process. This webinar, the last in a six-part series, helps legal leaders think proactively about appeals from day one. A certified appellate specialist will reveal how early engagement with appellate counsel can influence trial strategy, protect the record, and enhance the chances of success on appeal. Attendees will gain a clear understanding of procedural timelines, key standards of review, and how to spot appeal-worthy issues as a case unfolds. Beyond the technical guidance, this session will empower in-house counsel to be strategic partners in litigation. Whether defending a win or challenging an unfavorable verdict, this session provides the insights needed to make the appellate process work for the in-house counsel’s organization.

Session 4: Effective Dispute Resolution — When to Litigate vs. Arbitrate
Choosing the right forum for dispute resolution can save time, money, and relationships. This session will guide in-house counsel through key considerations, including:

  • Pros and cons of litigation vs. arbitration vs. mediation
  • Enforcing arbitration agreements and class action waivers
  • Negotiation strategies to resolve disputes before they escalate
  • Recent court decisions impacting ADR clauses

There is no cookie-cutter approach to resolving disputes, and in-house counsel play a critical role in choosing the most effective path forward. In this webinar, the fourth in a six-part series, attendees will be equipped with the tools to make strategic decisions that align with business goals while minimizing risk and cost. Seasoned in-house and outside counsel will examine the benefits and drawbacks of litigation, arbitration, and mediation, as well as practical guidance on drafting and enforcing ADR clauses. Attendees will also learn proactive negotiation techniques to resolve disputes early and efficiently, along with key takeaways from recent court rulings that may impact future agreements.
