This candid discussion will take a close look at the various diversity plans and programs being implemented within each company. The panelists will share some of the challenges that they have faced, as well as positive outcomes that have resulted because of their efforts.

Contestants answer and discuss legal ethics questions, hypotheticals and dilemmas posed by our Legal Ethics Hosts, who will involve the audience in competition with the panel as well as lively discussion on current legal ethics issues and rules of professional practice. Discussion will follow each question wherein the Legal Ethics Hosts will provide references to relevant rules, cases and ethics opinions.

To obtain leverage in the litigation and access the company's Directors and Officers' Insurance, plaintiffs' lawyers often name as defendants, individuals employed by the company.

This presentation will cover what the in house attorney needs to know concerning the possible insurance coverage available for officers and others named as defendants; the interplay between their rights and the company's obligations concerning indemnification and insurance; the effect of bankruptcy and/or the inability or refusal of the company to indemnify the individual defendants as well as the various ethical rules implicated under the Texas Rules of Professional Conduct.

Bob Dylan’s famous line “The times, they are a’ changin’” has never had more resonance than in the practice of law in 2020.  Remote work, meeting with clients and business partners virtually, taking fingers to keyboard rather than pen to paper, finding and producing evidence from the recesses of computer systems all raise ethical issues you probably never learned in law school or at traditional ethics seminars.

This rather untraditional, interactive presentation will address the ethical challenges of practicing law across electronic frontiers, including

  • How to satisfy the duty of technological knowledge and competence
  • Keeping client information and communications secure
  • Protecting that information across national borders within which privilege laws may differ significantly from those in the U.S.

In this evolving hypothetical, in-house counsel confront a series of issues, some prompted by COVID-19 and some not, and then are guided through the nuts and bolts of their ethical investigation and remediation. 

Anticipated topics include

  • Investigating alleged fraud arising from the pandemic
  • Investigating non-COVID issues such as corruption and harassment that in-house counsel continue to address, and
  • Related privilege, conflicts and other ethics implications. 

Implicit Bias in the Boardroom and the Courtroom - How to Recognize It and Deal With It

Implicit bias is
the unconscious attribution of particular qualities to a member of a certain social group. 

Even the most self-aware individuals probably harbor some implicit biases, whether they realize it or not.  These biases play out every day in corporate America and the judicial system. 

This seminar will address understanding, recognizing and counteracting implicit bias in the work place and the courtroom.
