Clinic will be virtual.  During the Covid-19 health pandemic, more low income Marylanders are realizing the need for the creation of estate planning documents. Having a simple will, advanced directive or power of attorney can give peace of mind to clients and have a significant impact on the distribution of assets upon their death. Under the guidance of Maryland Legal Aid, pro bono volunteers will be able to quickly and effectively prepare these essential documents for clients. Client information will be gathered in advance and training and document templates will provided. Prior estate planning experience is not needed.  Please register by May 13, 2021.

Our presenters will address some of these key, still evolving considerations, including:

  • COVID-19 testing--policies and considerations, including random testing of employees and required weekly testing
  • Vaccination--employment issues and considerations
  • Remote work--OSHA risks, workers compensation issues, potential policy changes, including business expenses
  • Reasonable accommodations and employee leave
  • Mental wellness

 

Many businesses are facing financial challenges, especially in light of the COVID-19 pandemic. During this presentation, our speakers will discuss aspects of doing business with financially-troubled businesses, both before and in bankruptcy. Their topics will include:

1. strategies for getting paid, protecting deposits and other property

2. exiting the relationship, and

3. enhancing credits.

In this session, we will take a close look at key issues in internal investigations, including whistleblower protections, scoping and starting an investigation as well as investigation best practices and privilege considerations, including a focus on return-to-work hot topics and permanent remote staffing considerations and potential sources of litigation.

Over the last year, in the midst of a global pandemic, we have been confronted with the harsh reality of institutional and systemic racism in America. Data privacy issues continue to be front and center in 2021. The California Consumer Privacy Act (CCPA) reached its first anniversary on January 1, 2021, yet was already materially amended by the Consumer Privacy Rights Act (otherwise referred to as the CPRA or CCPA 2.0) that passed by ballot initiative in the November election. The CPRA will bring even more compliance hurdles for companies across the U.S. (not just those in California) while removing certain liability protections afforded by the CCPA. Most recently, Virginia passed its own omnibus privacy legislation with other states appearing to be close behind.

Meanwhile, across the Atlantic, the Schrems II decision by the European Court of Justice invalidated the U.S. Privacy Shield program as a valid transfer mechanism for U.S. companies to transfer personal data from the EEA. The decision also sparked reactions across E.U. member states regarding whether the most common mechanism, standard contractual clauses (SCCs), remains valid for data transfers. Since the Schrems II decision, the European Commission issued a draft decision on the use of new SCCs for international data transfers along with a new set of SCCs.  Meanwhile, the European Data Protection Board (EDPB) issued guidance on cross-border data transfers, and together with the European Data Protection Supervisor adopted joint opinions on the new set of SCCs proposed by the Commission.  

What will happen next?  Will the new administration fuel even more legislative changes? We don’t have a crystal ball, but we will offer some strategies for meeting these and other regulatory challenges.
