After two years of altered work environments, many employers are moving forward with return to work plans this spring. Join Nutter's labor and employment team and a member of E Ink Corporation's in-house counsel in a discussion about what employers need to know for "the great return." While lawyers have an ethical responsibility to be zealous advocates for their clients, this is not synonymous with "winning at any cost."  What are the contours of zealous representation, and how can in-house counsel avoid running afoul of ethics rules?  We will examine the complex ethical issues facing in-house counsel who manage litigation, from the need to determine the truth to how best to control litigation costs, all while zealously representing the company.

In this session, we will explore and discuss the types of claims we believe are on the horizon for 2022, what steps employers ought to be thinking about now to prepare themselves for those claims, and at 24 months in, what the future holds for pandemic related issues.  We will also provide predictions about how the pandemic may have changed the way the courts manage and handle litigation in the future.

 

But We Had a Deal! How to Avoid Challenges to Your Settlement Agreements and Potential Remedies for Breach

The purpose of a settlement agreement is to resolve the dispute between the parties and to provide closure.  However, a party’s remorse or change in circumstances may cause that party to no longer want to be bound by the agreement.  A poorly drafted settlement agreement may not only create potential grounds to challenge the validity of the agreement but could also result in costly litigation or worse yet, a finding that there was no agreement to begin with.   For our round table, we invite an open discussion on best practices for drafting settlement agreements, some pitfalls to avoid, and potential damages, remedies and enforcement actions relating to breaches of settlement agreements.

Please join the ACC Georgia Chapter during women’s history month as we examine the evolution of legal careers for women attorneys, the obstacles female attorneys have faced, and the ongoing work to eliminate obstacles to female representation at the pinnacles of the profession. Come hear first-hand war stories from Georgia female attorneys who have faced these obstacles and overcome them.
