This program will look at the initial steps every company should take after it first learns of threatened litigation.  Topics will include:  preparing and implementing a proper litigation hold notice; evaluating possible removal or remand; ensuring work product and attorney-client privilege protections for the investigation; and alternative dispute resolution strategies.

Do you remember telling a teacher that you didn’t have your homework because the dog ate it? Using a cyberattack as an excuse for the unauthorized disclosure of your legal advice may be about as effective, and can also result in an ethics inquiry into violations of the duty of confidentiality. Worse, the report of the technical consultant you engaged to investigate and remediate the attack may not be subject to privilege if appropriate protections were not in place before the report was prepared.  In the wake of seemingly weekly cyberattacks and data breaches, this non-traditional and interactive discussion will address ethical challenges of practicing law across electronic frontiers as cybercrime increases exponentially, including:

  • How to satisfy the ethics requirements of technological knowledge, competence and the ability to explain technical challenges to the Board and C-Suite (i.e., your client).
  • The relationship between cybersecurity controls and the requirements of reasonable care to keep legal advice confidential.
  • Engagement of technical consultants following a cyberattack or data breach in a way that maximizes the availability of privilege regarding the consultant’s reports and communications.
  • Protecting communications across national borders within which privilege laws may differ significantly from those in the U.S.

The increasing focus on controlling the “litigation spend” and measuring litigation expenses against metrics can itself come at a high cost. Whether that cost is a high-profile loss or an unintentional misallocation of resources, it can be harmful when your company is facing serious litigation and it frequently undermines the original goals of corporate counsel. We will discuss the importance of building a relationship with your entire litigation team and embracing the unpleasant but inevitable tasks ahead. We will focus on achieving your goals in all kinds of litigation, by addressing the endgame at the outset and developing and committing to that endgame as litigation progresses to conclusion.

This October 7 virtual roundtable discussion, led by two high-profile litigators from Schnader Harrison Segal & Lewis LLP, will allow attendees to engage in an interactive conversation about these crucial issues. Over the past year, thousands of companies have been forced to reassess and revise their international data transfer practices in an effort to comply with GDPR.  The recent Court of Justice of the European Union (CJEU) decision known as Schrems II has created an atmosphere of uncertainty and an evolving legal landscape.  The CJEU’s decision in Schrems II invalidating the Privacy Shield poses significant questions and concerns for many companies handling European personal data or otherwise doing business in Europe.  This session will address the context and history of the Schrems II decision, updated guidance from the European Data Protection Board, and top considerations for business to update approaches to cross-border data transfers.
