The purpose of a settlement agreement is to resolve the dispute between the parties and to provide closure. However, a party’s remorse or change in circumstances may cause that party to no longer want to be bound by the agreement. A poorly drafted settlement agreement may not only create potential grounds to challenge the validity of the agreement but could also result in costly litigation or worse yet, a finding that there was no agreement to begin with. For our round table, we invite an open discussion on best practices for drafting settlement agreements, some pitfalls to avoid, and potential damages, remedies and enforcement actions relating to breaches of settlement agreements.
