"Conducting Internal Workplace Investigations – Guidance and Best Practices for In-House Counsel"

(1 hour of CLE approved for PA, NJ & DE)

As corporate counsel, you may find yourself charged with the responsibility to determine when, why, and how to conduct an internal investigation of alleged wrongdoing within your company. This program is designed to provide an overview of conducting an effective internal investigation and will address best practices for preparing, investigating and/or overseeing an investigation, preserving relevant data, and handling the findings of an investigation to mitigate litigation risks for the company. The program will focus on the ethical issues inherent when companies undertake internal investigations, including issues surrounding the attorney-client privilege.

Environmental, social, and governance (ESG) policies have become investment criteria. Customers, employees, shareholders, unions, and legislators demand that corporations adopt diversity, equity, and inclusion (DEI) and ESG policies. Historically, a business’s primary obligation may have been to generate shareholder value or profit. However, institutional investors have gained formidable power and influence because of their consolidated ownership. Within the confines of due diligence, institutional investors are expanding their analysis to ESG factors and other non-financial matters. Consumers, current employees, job candidates, and other stakeholders are interested in more than profit — they are interested in values-based decision-making. ESG policies are not a one-size-fits-all approach.

About Keplinger

Helen Keplinger’s time in Priorat working with grenache and finding unique singular vineyard sites for Melis was the inspiration for Keplinger wines. Helen and DJ Warner, her future life and business partner, met in a Spanish wine shop in Los Angeles in 2003. The couple moved to Napa Valley in 2005, where Helen was named winemaker for a new winery, Kenzo Estate. After settling back into Napa, Helen started searching for grenache and found a special vineyard in Knights Valley. With the 2006 vintage, Helen founded Keplinger and the couple released the first vintage in 2008 with a focus on small production, single-vineyard Rhône varietal wines. Since then, acclaim has been building, with press accolades naming Helen Food & Wine Magazine’s 2012 Winemaker of the Year and landing her on the cover of Wine Spectator’s June 15, 2014, edition with an inspirational story by James Laube.
